The fencing shall include, <br />at a minimum, the entire area beneath the tree canopy, which is known as the critical root zone. No <br />construction activity whatsoever may occur within these areas. Moreover, no construction shall begin until <br />this fencing has been installed and approved by the City. <br /> <br />Finally, any clearing involving oak trees cannot occur between April 15 and July 15 to protect against oak <br />wilt. If oak trees exist on or adjacent to the development area, a plan must be submitted outlining the <br />actions that will be taken to protect those trees from oak wilt. <br /> <br />Ground Cover/Irrigation. City Code requires all areas otherwise not improved to be established with sod. <br />Staff is assuming that the development will comply with this requirement. An irrigation system will need to <br />be provided throughout the development .where sodded and landscaped areas are established. The proposed <br />irrigation system will need to be reviewed by the City Engineer. The irrigation system will need a dedicated <br />service(s) that must be shown on the utility plan. - <br /> <br />~7. Sidewalks. A sidewalk is required on one side of all non cul-de-sac public streets, unless the City <br /> determines it is necessary to provide a sidewalk along a cul-de-sac street. The revised preliminary plat.is <br /> providing [bra sidewalk along the north side of 157th Avenue. <br /> <br />18. Trail Development. The Park and Recreation Commission recommended that a trail be installed in <br /> connection with the proposed boardwalk to the northeastern corner of the property. This would facilitate a <br /> future pedestrian connection to Highway #47. Trail fees will be required as part of the platting process. The <br /> rate in effect at time of final plat will be applied. The 2005 rate is $550 per unit, which equates to $12,650 <br /> /~br this development. <br /> <br />19. Park Dedication. Park dedication can be met by land, cash or a combination of land dedication and cash <br /> payment. The Park Commission recommended that park dedication be satisfied through a cash payment, <br /> which equates to $50,600 (23 units ~ $2,200/unit). <br /> <br />20. Sanitary Sewer and Water Trunk Fees: The city has established a sanitary sewer and water trunk fee that <br /> must be paid prior to release of the final plat for recording. The 2005 Rate is $2,962 per lot. The total <br /> amount due is $68,126 ($2962 x 23 units). This amount must be paid prior to the release of the final plat for <br /> recording. <br /> <br />21. Stormwater Management Fee: A storm water management fee of $375 per unit must be paid for all new <br /> lots created. The total amount due, based on the 2005 rate, is $8,625 ($375 x 23 units) and must be paid <br /> prior to release of the final plat <br /> <br />22. Other Permits. The applicant is responsible for any other'permits required by other regulatory agencies. <br /> <br /> <br />
