Background:

Last fall the City approved the posting of a series of chevron waming markers at the corner
of 169th Avenue and Neon Street. This posting was the result of a request by the resident at
this corner at 5866 169th Avenue to remedy the problem of having vehicles slide offthe
roadway and into his yard. Subsequent to the placement of these chevrons there was a
complaint regarding the aesthetics of these warning devices by Mr. Scott Baumgartner who
rcs ides at 5850 169th Avenue, which is immediately east of the comer property. He stated
the Public Works Committee recommended at their November 16, 2004 meeting that a
review of the situation be made at the May 2005 Public Works Committee meeting.

Thc Committee suggested any action on this item be tabled until the next Public Works
meeting when the other property owners can be present.

Action:

No action needed.

CASE #3 Sidewalk Repairs in the Ponds Subdivision

Background:

At thc April 19, 2005 Public Works Committee meeting staff presented the Committee
with a recommendation to repair a number of broken and substandard driveway sidewalk
pieces located in The Ponds subdivision. At that meeting the Committee made a
recommendation that staff be authorized to the repair of deficient sidewalks within The
Ponds subdivision and that all remaining escrow funds from the developer be retained to
pay for existing and future repair work. On May 5th the developer of this subdivision held a
meeting with City staff and requested that this recommendation be reconsidered. The
developers were invited to present their case to the Public Works Committee.

Mike Black of Royal Oaks Realty stated their company will repair any damaged sidewalks
and curbs in this development, and intends to do that this year. He does not see any reason
to take escrow money. The issue is concerning the 6-inch think sidewalk in the driveways,
as opposed to the entire sidewalk. He stated there was a problem with the communication
of that standard to their company as they did this development. He read the minutes from
the last meeting and sees that the City was in the process of changing the specs right at the
time The Ponds was approved. Royal Oaks Realty received the City's standard plate for
four-inch sidewalks. The sidewalks were started in 2002 and finished in 2003. Royal
Oaks Realty was not officially notified of the change in standards until they received a
letter fi'om Engineer Jankowski in 2004.

Staff stated the City did not have a transition in their sidewalk standards. This area is some
of thc first sidewalk that went into the City in a subdivision. The first sidewalk constructed
in thc city was that along Sunwood Drive which was done as part of the contract with the
state during the TH 47 project. The City simply did not have a standard. Royal Oaks
