Realty presented their specifications. The plan showed a 4-inch sidewalk, but the spec said <br />driveway sidewalks need to be 6 inches in driveways. The MnDOT standard for sidewalk <br />says within the driveway the sidewalk needs to be 6 inches. Staff considers six inches <br />through driveways as an industry standard. It was stated it was true that Royal Oaks Realty <br />never denied wanting to fix the sidewalks, but they never responded to staff. Staff wrote <br />four letters and the only response was a phone call back last fall saying they should wait <br />until spring. Another letter was sent back in February asking about a schedule and no <br />response was received. Staff did not have much choice but to go to thc Committee to get <br />this taken care of. Staffstated they share Mr. Black's concerns about removing all of the <br />sidewalks in the driveways. Staff felt a reasonable alternative was to replace the sidewalks <br />itl the driveways that are broken. The dilemma is if the sidewalks are not broken now and <br />break in the future, and if the City will pay for those sidewalks out of their pocket knowing <br />they allowed them to be put in not at industry standard. Staff recommended retaining a <br />certain amount of money from the developer to fix the sidewalks that will break in the <br />fitturc. They city would be taking a financial risk since it is uncertain how much sidewalk <br />may necd to be replaced in the future. <br /> <br />Motion <br /> · <br /> <br />to recommend that <br />Royal Oaks Realty complete all broken 4 inch (nondriveway) sidewalks and ped <br />ramps <br />Royal Oaks Realty complete all broken 6 inch driveway sidewalks, including the <br />adjacent unbroken sidewalks within the same driveway. <br />Royal Oaks Realty complete the repairs by August 1, 2005. <br />The City retain the $38,000 escrow money until one year after the completion of <br />these repairs. <br /> <br />Action: <br /> <br />Rali fy tile recommendation of the Public Works Committee. <br /> <br />CASE #4 <br /> <br />Consider Traffic Control Signal Agreement with MN/DOT for Signal <br />at TH 47 and XKIMO Street <br /> <br />Background: <br /> <br />Thc Tkl 47 project will include some modifications of the signals along TH 47, and <br />MnDOT is requesting that the signal agreements for these affected signals be updated. The <br />proposed agreement has been drafted to include all of the traffic signals which will be <br />constructed or modified under this summer's construction project, however, only System <br />"D" serving the intersection of TH 47 and Xkimo Street directly involves the City of <br />Ramscy. This signal will need to be modified as a result of the free right turn from <br />eastbound CSAH 5 to southbound TH 47. The terms of this agreement will require the <br />City to be responsible for about $1,900 in costs associated with the cost of modifying the <br />traffic signals at this location.
