He explained how the tables work to determine the buffer <br />width. <br /> <br />Commissioner Johnson stated you are then taking area that could be mowed to the edge of the <br />wetland and saying that must be landscaped and maintained. <br /> <br />Mr. Gordon stated it could also be left alone. <br /> <br />Commissioner Johnson indicated the ordinance says maintained. He stated he understands <br />requesting a developer put in landscaping, but if a homeowner has this area in back of their <br />property, what is their responsibility for maintaining it. He indicated if it is not established <br />clearly it will be abused, either intentionally or unintentionally. <br /> <br />Mr. Gordon commented that is why they are trying to require wetland monuments, and putting a <br />wetland buffer so it is obvious where the edge is. He indicated it will be a learning process to <br />educate thc public on what they can and cannot do. <br /> <br />Co~nmissioner Johnson asked how it will be enforced. He stated it is hard enough to get people <br />to mow their lawn, let alone maintain a buffer. <br /> <br />Mr. Gordon stated enforcement will be through the zoning code. <br /> <br />Commissioner Johnson indicated you can only have enforcement if there are clear lines to <br />enforce. Commissioner Johnson added it should also say the homeowner cannot build structures <br />in this area, or disrupt the area in any way. He asked if someone is putting an addition on their <br />house, and Staff is looking to see if this ordinance would apply, where they would look. He <br />suggested they put something in that says an application for this environmental permit is required <br />when, and list the circumstances specifically. He stated creating a lot of record is a given, but the <br />other circumstances should be listed. <br /> <br />Chairperson Nixt indicated 9.26.03 says all lands containing wetlands, which immediately makes <br />it applicable to all lots in the City. <br /> <br />Commissioner Johnson stated that gives more emphasis to why there needs to be a list of when <br />thc requirements are triggererd. <br /> <br />Chairperson Nixt asked who would review that delineation after it is done. <br /> <br />Joc McI)ilda, Chairman of the Environmental Policy Board, indicated maps and approval of <br />wetlands will be kept and managed by the Community Development Department. He stated the <br />intent is il' any area is becoming too extensive it will be brought forward to the appropriate <br />commission For review.
