Mr. tlendriksen stated that they have their readings, the supporters our interpretation. He stated <br />tie is not as worried about the City forcing people to hook up as he is worried about the MPCA, <br />Metropolitan Council, etc. They have asked for it in the past. <br /> <br />Councihne~nber Elvig stated these people would have to pay for all of these hookups. <br /> <br />Mr. l lendriksen stated the developer is being asked to place in an escrow account an amount of <br />money to covet' the fees that would be forced to pay if the people are forced to hook up to City <br />services. If you want to hook up, you would pay - if you are forced to hook up, this would help <br />pay the costs. Itc trusted the local authority would not initiate that. <br /> <br />Ms. Muehlhauser sated she was a signer of the petition and she feels she was misrepresented. <br />They said they were looking at people to not be forced to hook up. She did not know the <br />protection was already in the Charter. She did not feel other people should pay for her benefit <br />and she wondered how many other people were misrepresented. Ms. Muehlhauser stated that <br />she is looking at the constitutionality - if there is already protection - then she is okay with the <br />way things are. If someone tries to force us to hook up, then maybe vote on it at that time. <br /> <br />Mayor (}amec felt that it will stay this way - with protection. <br /> <br />Ms. Muehlhauser asked whether it's constitutional to make them put money aside for future <br />costs. <br /> <br />Mayor Gamec responded there are no guarantees but he feels as long as City Council is not <br />forcing hookup, there is no need. <br /> <br />Councihnember Elvig reiterated that the ordinance protects people from that. <br /> <br />Councihnember Cook stated that we have had opposing sides ever since City sewer and water <br />came out and it will continue to be that way. It's nothing to do with the Charter - it has to do <br />with people against people. <br /> <br />Councihncmber Elvig stated he would like the City Council to deliberate on this. It's almost <br />9:00 p.m. <br /> <br />Keith Kiefer, 6203 Rivlyn Avenue NW, stated it is his opinion that the petition with a proposed <br />charter amendment is yet another petition that is couched as "mom and apple pie". Not unlike a <br />question "when did you stop beating your wife?" Mr. Hendriksen has stated that the statement <br />that no one has been forced to hook up is intellectually dishonest. Mr. Kiefer asked how this is <br />difl'crent from Section 8.8 required hookup limitations which falsely leads one to believe that <br />Sectio~l 8.6.1 doesn't exist. Section 8.6.1 states "The City may not compel any property owner <br />with a functional private sewer and water system to connect to City sewer and/or water." He <br />offered lie could cite additional examples of intellectual dishonesty like the term leapfrog <br />development. Mr. Kiefer stated let's stop misrepresenting the notorious objective of the <br />proposed amendment. He believed the objective or result of this proposed amendment is to take <br />property owner's rights away and stop all growth.
