5) <br /> <br />Consideration of a Resolution Accepting the Resignation of the Associate Planner <br />and Authorizing Staff to Begin the Recruitment Process for an Associate Planner <br /> <br />Councihncmbcr Cook explained Associate Planner Megan Wald resigned form her position <br />effective June 9, 2005. Staff and the Personnel Committee recommend that Megan Wald's <br />resignation be accepted, and that the City Council grant authorization to begin the recruitment <br />process to fill the Associate Planner vacancy. <br /> <br />Thc Councilmcmbers expressed that they have enjoyed working with Ms. Wald and wished her <br />well. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Pearson, to ratify the <br />recommendation of the Personnel Committee in Case No. 5 and to accept Megan Wald's <br />resignation fi'om her position as Associate Planner effective June 9, 2005. <br /> <br />Motion carried, Voting Yes: Mayor Pro Tem Elvig, Councilmembers Cook, Pearson, Jeffrey, <br />Olson, and Strommen. Voting No: None. Absent: Mayor Gamec. <br /> <br />Case #20: <br /> <br />Adopt Resolution Authorizing for the Acquisition of Property for Park and <br />Trail Purposes <br /> <br />Assistant Public Works Director Olson explained the City desires obtaining a one acre parcel that <br />lies between TH 47 and County Ditch 3 north of 160th Lane and Elmcrest Park for the purpose of <br />constructing a pedestrian trail access to the park from the south. He reviewed the following <br />chronology of the efforts undertaken by the City towards this acquisition: <br /> <br />· November 2004 the City hired Watson Appraisal and Consultant Service to prepare an <br /> appraisal of the property. The property was received on December 3, 2004. <br />· On February 14, 2005 staff presented the landowner with an offer in the appraised amount of <br /> $1,000 and advised of the right to obtain an independent appraisal at City expense. <br />· On March 10, 2005 the property owner made a counter offer of 2005 in the amount of <br /> $31,500. The Public Works Committee considered this counterproposal not to be acceptable. <br />· On April 12, 2005 the City Council made a motion to authorize the use of eminent domain <br /> and direct staff to continue negotiations for an agreed price for the parcel and to authorize <br /> staff to work on obtaining a right-of-entry or trail easement that would allow the trail to be <br /> built while negotiations are proceeding. <br />· On May 5, 2005 staff relayed the City Council's decision on the counterproposal to the <br /> property owner and requested consideration of a right-of-entry to the parcel. <br /> <br />City Council/May 24, 2005 <br />Page 23 of 26 <br /> <br /> <br />
