Councilmember Hendriksen inquired if the City Attorney was okay with the concept that the <br />residents would still be able to withdraw their name up until the next regular City Council <br />meeting. <br /> <br />City Attorney Goodrich replied that the Charter states that the residents can withdraw their <br />signatures up until the time that the Council has accepted the petition. <br /> <br />Councilmember Hendriksen inquired if staff had verified the signatures on the petition. <br /> <br />City Engineer Jankowski replied that staff has verified that the people that have signed the <br />petition are residents of Riverwood Hills. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to accept <br />plans and specifications and direct staff to solicit bids for the 2001 Street Maintenance Program <br />with Improvement Project #01-15 as an alternate and table action on acceptance of the petition <br />regarding Improvement Project #01-15 until June 12, 2001 to allow staff time to advise the <br />residents of the implications of the petition and their right to withdraw their signature. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Kurak. Voting No: None. <br /> <br />Case #4: <br /> <br />Request to Appeal Board of Adjustment Decision to Deny a Variance to <br />Height Restrictions for a Manufacturing Building; Case of Amcor Precast. <br /> <br />Community Development Director Frolik stated that the City received a variance request from <br />Amcor Precast to exceed the building height restriction established in City Code on the property <br />located at 6640 Industry Avenue. The Board of Adjustment denied the variance on May 1, 2001. <br />The applicant submitted a letter of appeal to the City Council. Amcor Precast is in the process of <br />expanding their facility and purchasing equipment that will require a minimum building height of <br />44-feet. City Code restricts building height to 35-feet; therefore, Amcor Precast is requesting a <br />nine-foot variance from building height restrictions in order to operate a new indoor crane. The <br />Fire Chief indicates that the maximum reach capability of the Fire Department for fire <br />suppression and rescue operations is 35 feet. Concern is expressed relating to the possible <br />impairment of fire suppression and rescue activities resulting fi.om equipment that cannot reach <br />the roofline. Ramsey does have a joint powers agreement with the Anoka and Andover Fire <br />Departments for emergency assistance and those Departments do have aerial ladder trucks with <br />reach capabilities in excess of 44 feet. The Fire Chief also notes that the City Administrator will <br />recommend to the City Council that an aerial ladder truck be placed in Ramsey's 2002 Capital <br />Equipment Plan. According to the Uniform Building Code, Amcor Precast will be required to <br />sprinkle the office and manufacturing addition. Amcor will also be installing a sprinkler system <br />into the existing manufacturing plant. However, sprinklers are designed to contain a fire, not put <br />them out.
