fill will not <br />5.That the impact essential public facilities and services, such as highways, <br />streets, police and fire protection. <br /> <br /> fill will not <br />6.That the create excessive additional requirements at public cost for public <br />will not <br />facilities and services and be detrimental to the economic welfare of the <br />community. <br /> <br /> fill will not <br />7.That the involve uses, activities and equipment that will be detrimental to any <br />persons, property, or the general welfare by reason of excessive production of traffic, <br />noise, smoke, fumes, glare or odors. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> approves/denies <br />1.That the Ramsey City Council hereby the Conditional Use Permit for fill within <br />a floodplain contingent upon the following conditions: <br /> <br />a.Conformance with Staff Review and approval of plans by the City Engineer. <br /> <br />b.Review to final legal form by City Attorney. <br /> <br />c.Removing/amending Conservation and Trail Easement on the Subject Property so that <br />retaining wall is in conformance. <br /> <br />d.Review of modeling to ensure that fill has created no rise (Certificate of No Rise required, <br />confirming that the fill has no created more than a 0.0 foot rise) <br /> <br />2.That the Ramsey City Council directs Staff to begin the process of vacating the Conservation and <br />Trail Easement on the Subject Property and bring back final settlement offer. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Riley, and <br />upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor LeTourneau <br /> Councilmember Menth <br /> Councilmember Riley <br /> Councilmember Kuzma <br /> Councilmember Specht <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br /> None <br /> <br /> <br /> <br />RESOLUTION #20-256 <br />Page 2 of 3 <br /> <br /> <br />
