Councilmember I-Iendriksen stated that he did not see why it should matter who rezones the <br />property because the propose of a zoning ordinance is to protect an investment someone has <br />made in a home. <br /> <br />Councihnember Anderson noted that she could not agree that a commercial/industrial use would <br />be better than a residential use. <br /> <br />Councilmember Hendriksen replied that if the choice is between a property with a business park <br />and an apartment building or small lot townhouses, a person might think the business would be <br />less intrusive. <br /> <br />Mr. Bakken inquired if Councihnember Hendriksen felt that paragraph two should be changed. <br /> <br />Councilmember Hendriksen replied yes. <br /> <br />Councilmember Kurak stated that she would like to take out the wording "at the request of the <br />property owner", but leave the paragraph in. She noted that when a property is rezoned from <br />commercial to residential it is devalued. <br /> <br />Mayor Gamec stated that in a situation where the City rezones the property the property owner <br />probably has had the land for some time and held onto it so he did not think that they should be <br />penalized for not developing the property sooner. <br /> <br />Councihnember Hendriksen replied that a property owner is not guaranteed a certain zoning. <br /> <br />Councilmember Zimmerman stated the he did not know the difference between the City rezoning <br />the property or the property owner doing so. He felt the Council should be concerned with what <br />the outcome of the rezoning would be regardless of who rezones the property. <br /> <br />Mr. Bakken reviewed the proposed language removing the wording "at the request of the <br />property owner.". <br /> <br />Councilmember Hendriksen stated that there were so many twist and turns in the language that it <br />was ahnost unworkable. <br /> <br />Councilmember Anderson inquired as to why paragraph #1 was included. <br /> <br />Councilmember Hendriksen stated that he did not necessarily agree with the language in <br />paragraph # 1. <br /> <br />Councihnember Anderson stated that it appears that the language is giving preferential treatment <br />to certain property owners. <br /> <br />City Council/November 26, 2001 <br /> Page 2 of 11 <br /> <br /> <br />
