factor to him. Mr. Swanson stated that he appreciated the attention the Council has given the <br />permit. As it pertains to the depth of the pond and how much soil has been removed, he did not <br />think those issues were significant because the end product will be a benefit to the area. He felt <br />that Mt'. Enstrom has done a lot to try and not impact the neighbors, but noted that he would like <br />Mr. Enstrom to follow the rules as well. <br /> <br />City Attorney Goodrich stated that Mr. Enstrom does need to know what he is allowed to export <br />and for that reason he recommended the following language be added to condition #1: "This <br />permit shall permit Permittee to excavate and export no more than 144,000 cubic yards of earth <br />material fi'om the subject property during the term 1997 through November 30, 2004. The <br />Permittee states that as of the date hereof, less than 50,1300 cubic feet have been removed from <br />the subject property." <br /> <br />Consensus of the Council was to add the language to condition #1 as recommended by the City <br />Attorney. <br /> <br />Councilmember Zimmerman inquired if the conditional use permit needed to address number of <br />employees. <br /> <br />Mr. Enstrom noted that he has two full-time employees and several part-time employees. <br /> <br />Councilmember Hendriksen stated that he did not recall having that restriction on other mining <br />and grading pemfits. <br /> <br />Consensus of the Council was that the number of employees did not need to be addressed in the <br />conditional use permit. <br /> <br />Councilmember Hendriksen inquired as to how they were going to resolve the issue of hours of <br />operation from sunrise to sunset when they are hearing from residents that the machinery is <br />audible off the property and the findings state that is not the case. <br /> <br />Mayor Gamec replied that the sunrise to sunset hours of operation are less than the regular <br />construction hours. <br /> <br />Counci hnember Hendriksen replied that construction of a house does not go on for three years. <br /> <br />Motion by Councihnember Kurak, seconded by Councilmember Anderson, to adopt Resolution <br />#01-11-417B approving John Enstrom's request for a conditional use permit to grade and export <br />soils as presented in writing adding the various amendments made throughout the evening as <br />recorded. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, and <br />Hendriksen.
