Board Member introduced the following resolution and moved for its adoption: RESOLUTION #05-06- A RESOLUTION APPROVING THE ISSUANCE OF A VARiANCE AND DECLARiNG TERMS OF SAME. WHEREAS, Mr. Ben Deemer, 14501 Sunfish Lake Blvd. has properly applied for a variance from Section 9.20.12, Subd. 4, regarding how the maximum density is calculated in the R-2 Zoning District., on the property legally described as follows: That part of the Northwest Quarter of Section 25, Township 32, Range 25, Anoka County, Minnesota described as follows: Commencing at the west quarter comer of said section 25; thence north 90-degrees 00 minutes east along the southerly line of said Northwest Quarter a distance of 829,60 feet; thence north 30 degrees 49 minutes 30 seconds west 401.96 feet; thence north 29 degrees 55-minutes 10 seconds west 37.20 feet to the actual point of beginning;: thenc, e continuing north 29 degrees 55 minutes 10 seconds west 177.00 feet; thence north 87 degrees 34 minutes 50 seconds east 278.50 feet more or less to the center line of County State Aid Highway No. 5; thence south 29 degrees 55 minutes 10 seconds east along the center of said Highway No. 5 a distance of 177.00 feet; thence south 87 degrees 34 minutes 50 seconds west a distance of 278.5 feet more or less to the point of begirming. And Outlot E, Wood Pond Hills, Anoka County, Minnesota (the "Subject Property) WHEREAS, the Board of Adjustment met On Jdne '23, 2005, conducted the public hearing and adopted findings of fact relating to the request for a variance to density calculations. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows Based on Resolution #05-06-__ adopting Findings of Fact #0 , a variance to the density calculations, as established .in Section 9.21.12(4) of the Ramsey City Code, is approved on the Subject Property. That the gross land area shall be used to calculate the density on the Subject Property. The Permittee shall be responsible for all City costs incurred in processing the variance request.
