CASE # <br /> <br />REQUEST FOR A VARIANCE FROM MAXIMUM FRONT YARD SETBACK <br />REQUIREMENTS; CASE OF RAMSEY TOWN CENTER, LLC, <br /> AND TOWN & COUNTRY HOMES <br /> By: Sylvia Frolik, Asst. Com. Dev. Dir./HRA Exec. Dir. <br /> <br />Background: <br /> <br />Town & Country Homes and Ramsey Town Center, [,LC, are proposing to develop the proposed <br />plat of Symphony at Town Center. The development consists of 190 townhome units on <br />approximately 21 acres. The following items are enclosed for your information: <br /> <br />a) <br /> <br />c) <br />d) <br /> <br />Site location map <br />Preliminary Site Plan <br />Proposed resolution to adopt findij!gs of fact <br />Proposed resolution to approve the:variance <br /> <br />Observations: :"'" <br /> <br />The subject property is zoned Town Center Sub-district TC-4a. Section 9.20.25 (3) (b) of City <br />Code establishes a minimum front yard setback of 0 feet and a maximum front yard setback of <br />20 feet, as measured from building front to sidewalk edge. The townhome structures on Lot 5, <br />Block I, Lots 1 and 2, Block 2, and Lot 1, Block 3, front on Rhinestone Street N.W. and are <br />located approximately 27-36 feet from the sidewalk edge. The location of the sidewalk is <br />outside the plat boundaries, in the right-of-way for Rhinestone Street N.W. The location of the <br />sidewalk is in accordance with the Park and Trail Dedication Agreement for Town Center, but <br />extends the measurement distance. <br /> <br />In addition, Rhinestone Street N.W. is a curved design which results in varied setbacks for large, <br />rectangular structures located parallel to the street. <br /> <br />The Planning Commission and City Council approved the preliminary site plan contingent upon <br />the applicants receiving a variance to the maximum front yard setback. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the variance. <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution #05-06- adopting Findings of Fact # relating to a request <br />from Town & Country Homes and Ramsey Town Center, LLC, for a variance to maximum front <br />yard setbacks in the TC-4b District. <br /> <br />-and- <br /> <br /> <br />
