Bock, Jr. <br />DATE: March 3, 1998 <br />Re: Rum River North Park / North Pointe <br />This memorandum concerns the status of the City's ownership of <br />the above -referenced property. It is my opinion that no <br />restrictions or encumbrances presently exist with respect to that <br />specific property. The property may be used for any appropriate <br />municipal purpose or may be sold. A sale of part or all of the <br />property wouid require the adoption of an Ordinance approved by <br />4/5ths of the City Council. The following paragraphs address <br />certain matters which relate to the status of the property. <br />1_ Tilp Documents. The land refei-red to as Rum River <br />North Park or North Pointe is shown on the map attached to thin <br />memo a Exhibit A. The City of Anoka acquired fee title to the <br />land in 1971 from the State of Minnesota by a Quit Claim Deed, a <br />copy of which is attached as Exhibit. B. The deed contains no <br />convenants, conditions or restrictions. There are no <br />encumbrances on title to the property shown in the records of the <br />Anoka County Recorder. <br />2. HUI,v_Gran. The property was acquired with money from a <br />Federal'Grant administered by the Department of Housing and Urban <br />Develoriment (HUD). A copy Of the complete "City of Anoka <br />Application for Grant to Acquire Open -space Land, Anoka, <br />Minnesota, October, 1968" is at City Hall. The following <br />attached exhibits relate to the HUD Grant; <br />(a) Exhibit C - page 08101-3 of the Application. <br />(b) Exhibit D - page 0S102-2 of the Application. <br />(c) Exhibit E - Contract for Grant to Acauire arid/or <br />Develop Land for Open -space Purposes under Title <br />VII of the Housing Act of 1961, as Amended. <br />(d) Exhibit F - Letter from HUD dated June 24, 1971. <br />(e) Exhibit G - Letter from HUD dated July 12, 1971. <br />(f) Exhibit H - Letter from HUD dated Fbruary 14, <br />1972. <br />
