I 11 .,11 X 1,1 11,0 '0 L,0,0 lel 111,1, <br />Anoka City Council <br />Page 2 <br />March 3, 1998 <br />(g) Exhibit I - Letter from HUD dated January 16, <br />1991. <br />At the time the land was purchased, the City had, an <br />obligation to retain the land for "permanent open -space purposes <br />and, the open -space use or uses of said land shall be for park and <br />recreational Purposes, conservation of land and other natural <br />resources, or historic or scenic purposes." (See Section 2(b), <br />Exhibit E.) However, in 1991, HU advised the City that all <br />Federal restrictions on the Use of open -space sites had been <br />removed. (See Exhibit 1, which'specifically refers to "Rum River <br />North Park, Property, 1969 Open -Space Grant.") <br />3. Prior, Transfers. Part.of.theland is now within County <br />Road No. 116 as shown on Anoka County Highway. Right -of -Way Plat <br />No. 31. (See Exhibit A.) The City of Anoka conveyed a portion of <br />the land (about 4.7 acres) south of County Road No. 116 to Anoka <br />Area Ice Arena Association, Inc. in 1991 by Quit Claim Deed, a <br />copy of which is attached as Exhibit J. <br />4. County Library. The City of Anoka and the, County of <br />Anoka entered into, an, Agreement in 1993 pursuant to which the <br />City agreed to convey to the*County approximately 12 acres of <br />land adjacent to County Road 116 on the condition that the <br />property be used by the County to build and,operate a regional <br />branch library on or before July 1, 2000. (Exhibit K) <br />5. Park. Although the land is often. reterred to as a park <br />and there is at least one sign sd indicating on the property, the <br />City Council is free to use the land or sell the land as it deems <br />appropriate. The situation would be different if the. land had <br />been dedicated to the public for park purposes, such as isthe <br />case with platted land where a portion of the property is <br />dedicated as "park" in accordance with Minnesota Statutes, <br />Chapter 505. (In the case of land dedicated as "park," on a plat,, <br />the City either may use the land only as a park or may vacate the <br />park, in which case the ownership of the land reverts to the <br />original owner ot the plat.) <br />
