CASE <br /> <br />CONSIDER THE ACQUISITION OF PROPERTY FOR <br />PARK AND TRAIL PURPOSES <br /> By: Steven J. Jankowski, City Engineer <br /> <br />Back,round: <br /> <br />Thc City desires obtaining a one acre parcel which lies between TH 47 and County Ditch 3 north <br />of 100th l..ane and Ehncrest Park for the purpose of constructing a pedestrian trail access to the <br />park fi'om the south. Staff has been directed to attempt to acquire this property through <br />negotiations with Mr. Lynn Mortenson, the property owner. The following is a brief recap of the <br />cf forts undertaken by the City towards this acquisition: <br /> <br />· November 2004 the City hired Watson Appraisal and Consultant Service to prepare an <br /> appraisal of the property. The appraisal was received on December 3, 2004. The county <br /> assesscd value of this property is $6,500. <br />· On Fcbruary 14, 2005 staff presented the landowner with an offer in the appraised <br /> amount of $1,000 and advised of the right to obtain an independent appraisal at City <br /> CXpCI]SC. <br /> <br />· On March 10, 2005 the property owner made a counter offer of 2005 in the amount of <br /> $31,500. <br />· On April 12, 2005 the City Council rejected the owner's counteroffer and authorized the <br /> t~se Of cminent domain, but directed staff to continue negotiations with the property <br /> OWIlOr. <br /> <br />Staff has rcceived a verbal agreement with Mr. Mortenson to acquire this property for $11,000 <br />which is within the guidelines provided to staff for the acquisition of this property. <br /> <br />Recommendation: <br /> <br />Staff rccommends that the Committee recommend to the City Council acceptance of the amount <br />o 1~ $11,000 for the acquisition of this approximate one acre parcel for park and trail purposes. <br /> <br />Action: <br /> <br />Motion to rccommend to the City Council acceptance of the amount of $11,000 for the <br />acquisition of this approximate one acre parcel for park and trail purposes. <br /> <br />Reviewed By: <br />Public Works Director/Fire Chief <br />Assistant Public Works Director/Principal Engineer <br />City Attorney <br /> <br />PW: 06/21/05 <br /> <br /> <br />
