CASE CONSIDER THE ACQUISITION OF PROPERTY FOR PARK AND TRAIL PURPOSES By: Steven J. Jankowski, City Engineer Back,round: Thc City desires obtaining a one acre parcel which lies between TH 47 and County Ditch 3 north of 100th l..ane and Ehncrest Park for the purpose of constructing a pedestrian trail access to the park fi'om the south. Staff has been directed to attempt to acquire this property through negotiations with Mr. Lynn Mortenson, the property owner. The following is a brief recap of the cf forts undertaken by the City towards this acquisition: · November 2004 the City hired Watson Appraisal and Consultant Service to prepare an appraisal of the property. The appraisal was received on December 3, 2004. The county assesscd value of this property is $6,500. · On Fcbruary 14, 2005 staff presented the landowner with an offer in the appraised amount of $1,000 and advised of the right to obtain an independent appraisal at City CXpCI]SC. · On March 10, 2005 the property owner made a counter offer of 2005 in the amount of $31,500. · On April 12, 2005 the City Council rejected the owner's counteroffer and authorized the t~se Of cminent domain, but directed staff to continue negotiations with the property OWIlOr. Staff has rcceived a verbal agreement with Mr. Mortenson to acquire this property for $11,000 which is within the guidelines provided to staff for the acquisition of this property. Recommendation: Staff rccommends that the Committee recommend to the City Council acceptance of the amount o 1~ $11,000 for the acquisition of this approximate one acre parcel for park and trail purposes. Action: Motion to rccommend to the City Council acceptance of the amount of $11,000 for the acquisition of this approximate one acre parcel for park and trail purposes.
