Case #7: <br /> <br />Authorization for Sale of Property to Anoka County Community Action <br />Program (ACCAP) <br /> <br />City Attorney Goodrich stated that at its May 8, 2001 meeting, the Council introduced an <br />ordinance to permit the sale of the City owned property at the intersection of T.H. #47 and the <br />newly constructed Sunwood Drive extension. This is approximately 11.2 acres, which is the <br />subject of the February 18, 1999 purchase agreement between the City and ACCAP. Passage of <br />this ordinance is consistent with the settlement agreement the Council previously approved with <br />regard to the lawsuit commenced by ACCAP on this subject. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Kurak, to adopt Ordinance # <br />01-20 authorizing the sale of the property legally described on Exhibit A, which is approximate <br />11.2 acres site sold to ACCAP pursuant to a February 18, 1999 purchase agreement. <br /> <br />Further discussion: Councilmember Hendriksen stated that he does not support extending a tax <br />refund in the amount of $190,000. Councilmember Anderson replied that Councilmember <br />Hendriksen negotiated the contract. Councilmember Hendriksen replied that he negotiated the <br />purchase price several years ago. <br /> <br />A roll call vote was preformed by the Recording Secretary: <br /> <br />Councilmember Kurak aye <br />Councilmember Zimmerman no <br />Councilmember Hendriksen no <br />Councilmember Anderson yes <br />Mayor Gamec yes <br /> <br />Motion carried. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Anderson, to authorize the Mayor and <br />City Administrator to execute the necessary legal documents to sell the real property legally <br />described on Exhibit A pursuant to the terms of the February 18, 1999 purchase agreement <br />between the City and ACCAP and the terms of the settlement agreement between the City and <br />ACCAP relating to the Anoka County District Court law suit commenced by ACCAP to compel <br />closing on the purchase agreement. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, and Kurak.
