CASE <br /> <br /> PUBLIC HEARING <br />REQUEST FOR VACATION OF EASEMENTS IN <br />TOWN CENTER GARDENS 3RD ADDITION; <br />CASE OF BRIGHTKEYS, INC. <br /> By: Amy Geisler, AICP, Associate Planner <br /> <br />Background: <br /> <br />The City Council approved the preliminary plat of Town Center Gardens 3rd Addition on April <br />12, 2005. '['he 3rd Addition is a re-plat of portions of the 1st and 2nd Additions of Town Center <br />Gardens, which included the standard drainage and utility easements. These easements must now <br />be vacated to allow for the recording of Town Center Gardens 3rd Addition, which includes new <br />drainage and utility easements. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />Site location map <br />Exhibits of underlying easements to be vacated <br />Proposed ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted t° notify property owners within 350 feet <br />of the subject property of the public hearing to vacate easements. <br /> <br />O bsmwations: <br /> <br />It takes a public hearing and Council ordinance to eliminate the underlying drainage and utility <br />easements that exist as part of Town Center Gardens lSt.and 2nd. Additions.
