Water Usage in a Critical Water Deficiency, LMC Model Ordinance <br />League models are thoughtfully developed by our staff for a city s consideration. Models should be <br />customized as appropriate for an individual city's circumstances in consultation with the city's attorney. <br />Helpful background information on this model may be found in "Securing Payment of Utility Charges." <br />This icon marks places where the city must customize the model. They offer <br />additional provisions, optional language, or comments for your consideration. The <br />icon, and language you do not wish to include, should be deleted from this model <br />before use. Make other changes, as needed, to customize the model for your city. <br />ORDINANCE NO. <br />AN ORDINANCE REGULATING NONESSENTIAL WATER USAGE UPON <br />CRITICAL WATER DEFICIENCY AS AUTHORIZED BY MINN. STAT. § 103G.291, <br />SUBD. 1 AND 2. <br />o <br />This model ordinance was drafted in collaboration with the Minnesota Rural Water Association. <br />Under Minnesota Statute section 103G.291, cities are required to adopt and enforce water <br />conservation restrictions when the governor declares a critical water deficiency. Some cities may <br />already have such restrictions in their water supply plans. <br />The City Council of , Minnesota ordains: <br />SECTION 1. PURPOSE. <br />This ordinance establishes water conservation restrictions; and the plan will be in effect at any <br />time the governor declares by executive order a critical water deficiency, pursuant to Minnesota <br />Statutes section 103G.291. <br />SECTION 2. DEFINITIONS. <br />2.1 Clerk in statutory cities means the person assigned duties pursuant to Minn. Stat. § 412.151; <br />or the city manager pursuant to Minn. Stat. § 412.601 — 412.751 or in charter cities as <br />determined by city charter. <br />2.2 Department means the city water department. <br />2.3 Emergency means the declaration of a critical water deficiency by the governor. <br />2.4 Irrigation means the watering of shrubs, trees, sod, seeded areas, gardens, lawns, or any <br />other outdoor vegetation, except outdoor vegetation utilized for agricultural purposes. <br />2.5 Notification to public means notification through local media, including interviews and <br />issuance of news releases. <br />League of Minnesota Cities Model Ordinance: <br />Water Usage in a Critical Water Deficiency <br />10/24/2018 <br />Page 1 <br />
