83 <br />6115.0440 OWNER'S RIGHTS. <br />MINNESOTA RULES 6115.0480 <br />Nothing in these parts shall be construed to deprive any owner of such recourse to the courts. <br />Statutory Authority: MS s 105.535 <br />Published Electronically: June 11, 2008 <br />6115.0450 INSPECTIONS. <br />Owners of dams shall allow the commissioner prompt access to and inspection of all records, <br />plants, structures, facilities, and operations at all reasonable times. Entry is subject to reasonable <br />compliance with the owner's safety rules and avoidance of unreasonable impairment of or interference <br />with construction and operation. Inspection shall be limited to testing and observing rather than <br />supervising and shall not relieve the owner from the full responsibility of providing adequate <br />inspection and supervision. <br />Statutory Authority: MS s 105.535 <br />Published Electronically: June 11, 2008 <br />6115.0460 COMPLIANCE WITH OTHER LAWS. <br />The owner of a dam shall comply with all other state and federal laws and regulations and shall <br />obtain such other permits as may be required including particularly any laws and rules regarding <br />mineland reclamation. <br />Statutory Authority: MS s 105.535 <br />Published Electronically: June 11, 2008 <br />6115.0470 ACQUISITION OF PROPERTY. <br />Where activities authorized by a permit involve the rights or interests of any other persons, or <br />of any public interests, the permittee, before proceeding, shall acquire all necessary interests or <br />permissions, including paying the costs of the alteration, relocation, or replacement of any publicly <br />owned facility. <br />Statutory Authority: MS s 105.535 <br />Published Electronically: June 11, 2008 <br />6115.0480 ASSIGNMENT OF PERMITS. <br />Permits may be assigned in whole or in part only if the commissioner is notified and approves <br />the assignment in writing.
