99 <br />MINNESOTA RULES 6115.0710 <br />6115.0700 ADDITIONAL REQUIREMENTS AND CONDITIONS FOR WATER LEVEL <br />MAINTENANCE FOR BASINS. <br />Subpart 1. Additional application information. For water appropriation applications for the <br />purpose of establishing and maintaining water levels for basins the applicant shall submit the <br />following data in addition to the requirements of part 6115.0660: <br />A. information on the basin and proposed source of supply or source of discharge, including <br />facts indicating how the water will be appropriated and discharged and the proximity of the basin <br />to the proposed source of supply or source of discharge; and <br />B. information on the design of any discharge facility into or out of the basin. <br />Subp. 2. Commissioner's actions. The commissioner shall evaluate and make decisions on <br />applications based on facts supplied by the applicant and subject to the applicable procedures <br />outlined in part 6115.0670 and the following determinations: <br />A. effects on public welfare of the proposed appropriation; <br />B. the proposed appropriation is reasonable, practical, technically feasible, and effectively <br />accomplishes its purpose; <br />C. the proposed appropriation will have minimal or no detrimental effect on the basin, the <br />proposed source of supply, or the receiving water and property of riparian owners; <br />D. the quality of the water of the basin or the receiving water source will not be detrimentally <br />impaired by the appropriation; and <br />E. the proposed appropriation is consistent with part 6115.0221, item A, subitem (2), public <br />waters permits rules. <br />Statutory Authority: MS s 103G.315; 105.415 <br />Published Electronically: June 11, 2008 <br />6115.0710 ADDITIONAL REQUIREMENTS AND CONDITIONS FOR DEWATERING. <br />Dewatering, which involves appropriation of water from ground or surface water sources for <br />purpose of removing excess water, shall be subject to water appropriation permit requirements, <br />unless otherwise exempted by these parts. The commissioner shall evaluate and make decisions on <br />such application based on applicable provisions of parts 6115.0660 and 6115.0670 and the following <br />additional requirements: <br />A. The applicant must show there is a reasonable necessity for such dewatering and the <br />proposal is practical. <br />B. The applicant must show that the excess water can be discharged without adversely <br />affecting the public interest in the receiving waters, and that the carrying capacity of the outlet to <br />which waters are discharged is adequate. <br />C.
