109 <br />MINNESOTA RULES 6115.0760 <br />F. When the lease or contract for deed is forfeited or canceled. <br />G. Permits for agricultural irrigation shall be subject to termination by the commissioner <br />upon justifiable recommendation of the supervisors of the soil and water conservation district, <br />wherein the land irrigated is located, regarding the inadequacy of the soil and water conservation <br />measures. <br />H. When the commissioner deems it necessary for the conservation of the water resources <br />of the state or in the interest of public health, safety, and welfare. <br />I. When the commissioner deems it necessary pursuant to parts 6115.0730 and 6115.0740. <br />J. Any action pursuant to items B and D to I shall be subject to appropriate notice and <br />opportunity for hearing, except as provided in subpart 7. <br />K. In the case of permits for mining issued in conjunction with Minnesota Statutes, section <br />103G.297, procedures for termination shall be subject to provisions of Minnesota Statutes, section <br />103G.297, subdivision 8. <br />Statutory Authority: MS s 103G.315; 105.415 <br />Published Electronically: June 11, 2008 <br />6115.0760 LOCAL PERMITS. <br />The commissioner, pursuant to Minnesota Statutes, section 103G.271, subdivision 4, shall <br />delegate to municipal, county, or regional level of government the authority to process and approve <br />permit applications for the appropriation and use of waters of the state in amounts of more than <br />10,000 gallons per day and more than 1,000,000 gallons per year, but less than 3,600,000 million <br />gallons per year. Such delegation shall be made at the municipal, county, or regional level which <br />means a governmental entity, or several governmental entities in combination, having authority or <br />jurisdiction over areas of geographical extent beyond the limits of a single county, or a watershed <br />district. The delegation by the commissioner shall be subject to the following requirements: <br />A. The authorized unit of government has established an administrative process which <br />includes provisions for establishing a water appropriation management planning process consistent <br />with part 6115.0810. <br />B. The review and approval of applications are consistent with the applicable provisions <br />of these parts. <br />C. A formalized agreement is made and signed by the commissioner and the appropriate <br />municipal, county, or regional level authority involved. <br />D. Copies of all applications and records of local actions on applications are provided to <br />the commissioner upon receipt and action. <br />E. Records of water appropriation amounts and the processing fee shall be submitted by <br />the permittee to the commissioner as required by part 6115.0750, subparts 3 and 4, and Minnesota <br />Statutes, sections 103 G.271, subdivision 6, and 103 G.281, subdivision 3. <br />Copyright © 2019 by the Revisor of Statutes, State of Minnesota.
