6115.1380 <br />MINNESOTA RULES 136 <br />Statutory Authority: MS s 103G.105; 103 G. 315; 105.415; 105.49; 471.59 <br />History: L 1998 c 324 s 9 <br />Published Electronically: June 11, 2008 <br />6115.1390 EXCEPTION TO CRITERIA. <br />Under special circumstances, exceptions to the dike rules may be authorized on an individual <br />basis but they must have the concurrent approval of the North Dakota state engineer, local water <br />management board in North Dakota, Minnesota Department of Natural Resources, and local <br />watershed district in Minnesota. Factors that will be considered include but shall not be limited to <br />dike setback line, location of farmsteads, property lines, existing roads, stream velocity, <br />environmental effects, and acquisition of flowage rights. Request for exceptions must be accompanied <br />by a plan satisfactory to all agencies. <br />Statutory Authority: MS s 103G.105; 103 G. 315; 105.415; 105.49; 471.59 <br />Published Electronically: June 11, 2008 <br />6115.1400 APPLICATION OF RULES TO EXISTING DIKES. <br />These parts shall apply to all unauthorized dikes constructed in the past for the protection of <br />those agricultural lands located within the floodplains of the Red River of the North and the Bois <br />de Sioux, as defined in part 6115.1310. Exceptions are farmstead dikes if they meet the provisions <br />of part 6115.13 70. <br />The commissioner shall have the authority to order removal, modification, or reconstruction of <br />dikes not conforming to these parts. <br />Statutory Authority: MS s 103G.105; 103 G. 315; 105.415; 105.49; 471.59 <br />Published Electronically: June 11, 2008 <br />CONSOLIDATED CONSERVATION AREAS; <br />DRAINAGE PROJECTS <br />6115.1500 PURPOSE. <br />The purpose of parts 6115.1500 to 6115.1550 is to establish criteria and procedures for <br />determining drainage benefits to state-owned lands in consolidated conservation (con -con) areas <br />administered under Minnesota Statutes, chapter 84A.
