that on residential parcels of one (1) acre or more in size, a swimming <br />pool or spa may be constructed closer to the front lot line than the <br />principal structure, provided that such swimming pool or spa can <br />maintain a 200 foot setback from the property line. <br /> <br />A swimming pool or spa may not be located closer than four (4) feet to the <br />principal structure located on the parcel where the swimming pool or spa <br />is to be constructed. <br /> <br />2. No swimming pool or spa may be constructed within twenty (20) feet of <br /> any portion of an on-site sewer system or any private water well. <br /> <br />3. No person shall build, construct, locate or install a swimming pool and <br /> walkway or spa within any easement. <br /> <br />b. Fencing <br /> <br />Temporary Fencing. During the construction of any in-ground <br />swimming pool or spa, the construction area must be secured with a <br />portable fence which is not less than four (4) feet in height. <br /> <br />(a) Temporary fencing shall be flush with the ground and securely <br /> anchored. <br /> <br />(b) Supportive posts shall be placed no more than eight (8) feet apart. <br /> <br />2. Permanent Fencing. <br /> <br />All in~ground swimming pools and above-ground swimming pools <br />with a sidewall height less than four (4) feet must be completely <br />enclosed by a permanent fence or wall of a non-climbing type, which <br />has no external handholds or footholds, so as to be impenetrable by <br />toddlers. Chain link fence may be used. The entire enclosure must be <br />at least four (4) feet in height. The opening between the bottom of the <br />fence and the ground or other surface shall not be more than three (3) <br />inches. All outdoor fence or wall openings or outdoor points of entry <br />into the pool area shall be equipped with self-closing, self-latching <br />devices that are lockable. <br /> <br />All above-ground swimming pools that have a minimum side-wall <br />height of four (4) feet need not be fenced, but shall have removable <br />steps, which steps shall be removed when the swimming pool is <br />unattended. In the event that an accessory deck to the swimming pool <br />is constructed, which is adjacent to any part of the swimming pool, <br />said deck shall include, on its entire outside perimeter, a 36-inch high <br /> <br /> <br />
