WHEREAS, the Developer is the fee owner of certain real property situated in the City of Ramsey, County of Anoka, State of Minnesota legally described as Lot 1, Block 1, and OutEots A. B. C and D, ALPHA DEVELOPMENT. according to the recorded plat thereof (the "Property"): and WI-IEr EAS. a private school campus "Legacy Christian Academy") is proposed to be constructed on said Lot 1, Block 1 "Lot 1"), and the City has required that the Developer make provisions for the construction, maintenance and repair of a storm water management system that utilizes (amon other things) infiltration areas, sump manholes, storm sewer pipes, and ponding facilities "Storm Water Management Practices") located within the Property{, as shown on Exhibit "A" attached hereto and as the same are described and depicted in those certain construction plans drawn by Anderson Engineering of Minnesota. LLC (the -Plans"): and WI-IEES, the Storm Water Management Practices are sufficient to serve portions of the Property in addition to Lot 1; and WHEREAS, the City approved the Legacy Christian Academy conditioned on the requirement that the Developer enter into an agreement for the maintenance of the Storm Water - Management Practices within the Property; and Commercial Partners TitSs,1,LC 200 South Sixth Street Suite 1300 Minneopalis, MN 55402 33Z3c.p
