Councilmember Elvig reviewed that last fall the City approved the posting of a series of chevron <br />warning markers at the comer of 169t~ Avenue and Neon Street. This posting was the result ora <br />request by the resident at this comer of 5866 169th Avenue to remedy the problem of having <br />vehicles slide off the roadway and into his yard. Subsequent to the placement of these chevrons <br />there was a complaint regarding the aesthetics of these warning devices by Mr. Scott <br />Baumgartner who resides at 5850 169th Avenue, which is immediately east of the comer <br />property. The Public Works Committee recommended at their November 16, 2004 meeting that <br />a review of the situation be made at the May 2005 Public Works Committee meeting. <br /> <br />City Engineer Jankowski indicated action was tabled on this issue to the next Public Works <br />Committee meeting because one of the property owners was not present. <br /> <br />No Council action necessary. <br /> <br />3) Sidewalk Repairs in the Ponds Subdivision <br /> <br />City Engineer Jankowski stated at the April 19, 2005 Public Works Committee meeting staff <br />presented the Committee with a recommendation to repair a number of broken and substandard <br />driveway sidewalk pieces located in The Ponds subdivision. At that meeting the Committee <br />made a recommendation that staff be authorized to the repair of the deficient sidewalks within <br />The Ponds subdivision and that all remaining escrow funds from the developer be retained to pay <br />for existing and future repair work. On May 5t~ the developer of this subdivision held a meeting <br />with City staff and requested that this recommendation be reconsidered. The developers were <br />invited to present their case to the Public Works Committee. The recommendation of the Public <br />Works Committee at the May meeting was slightly different than the recommendation during the <br />April meeting. The recommendation is as follows: <br /> · Royal Oaks Realty complete all broken 4 inch (non-driveway) sidewalks and ped <br /> ramps. <br /> · Royal Oaks Realty complete all broken 6 inch driveway sidewalks, including the <br /> adjacent unbroken sidewalks within the same driveway. <br /> · Royal Oaks Realty complete the repairs by August 1, 2005. <br /> · The City retain the $38,000 escrow money until one year after the completion of <br /> these repairs. <br /> <br />Councilmember Elvig stated Mr. Black indicated he would truly like to repair his own problems. <br />Rather than the City taking the escrow funds and taking that burden on, Mr. Black seemed <br />genuine in wanting to repair the problems. It was the opinion of the Public Works Committee to <br />allow Mr. Black to do that work and to keep the warranty in effect for one year after that work is <br />completed and accepted. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Cook, to ratify the <br />recommendation of the Public Works Committee for Case No. 3 and to direct that <br /> · Royal Oaks Realty complete all broken 4 inch (non-driveway) sidewalks and ped <br /> ramps. <br /> · Royal Oaks Realty complete all broken 6 inch driveway sidewalks, including the <br /> adjacent unbroken sidewalks within the same driveway. <br /> <br />City Council / June 14, 2005 <br /> Page 26 of 29 <br /> <br /> <br />
