Mr. Voss stated that he will commit on behalf of Ramsey Town Center LLC that when they <br />develop the plat to the east that co~mection will be addressed, <br /> <br />City Engineer Linton stated he wonders if putting a private street on land with two different <br />owners may be an issue. <br /> <br />Mr. Voss indicated they coutd convey cross easements for the road as necessary. <br /> <br />Ms. Novack indicated that there are row style towr~homes facing Bunker Lake Boulevard, with <br />an eight-foot regional trail in the County right-of-way. She stated typically they have a five-foot <br />private sidewalk to connect entryways, but they currently do not have enough room to provide a <br />five-foot sidewalk without encroaching into the County right-of-way. She indicated without that <br />space, every entryway would connect directly to a public trail, and they saw that as a design issue <br />and a safety issue. She indicated for this-reason they are proposing to encroach or/. the County <br />right-of-way witl~ a 5' sidewalk. <br /> <br />Mr. Lipman explained that right now there is thirty feet of extra right-of-way in this 'area. He <br />stated that when the regional trail is designed it is like!.y it will sit further to the north. He <br />indicated they have had initial discussions with the Cofinty and ihe County seems agreeable to <br />having a sidewalk connection in addition to the trail. <br /> <br />Vice Chairperson Johnson asked what the total right-of-way is in this area. <br /> <br />Mr. Lipman stated it is 150 feet; 60 feet on the north, and 90 feet on the south. <br /> <br />Mr. Voss noted that the increased right-of-way extends the entire width of Symphony, and he can <br />commit on behalf of Ramsey Town Center LLC that they will not request this concession for any <br />other plat along Bunker Lake Boulevard. <br /> <br />City Engineer Linton indicated that, Staff is not in favor of this proposal. He stated they have <br />found as they are trying to increase street size in the area that they are running out of space. He <br />agreed there is extra right-of-way here, but is concerned it sets a precedent. He stated the City <br />has other developments that have the same situation and have sidewalks coming right out to a <br />public sidewalk or trail. <br /> <br />Vice Chairperson Johnson indicated the City is better off having the sidewalk in the County <br />right-of-way because then the County can control it. He stated the County grants a license to use <br />the land so they can move it whenever they need to do so. He indicated he understands StafFs <br />concerns, but a license will give the County and the City the most flexibility if the road does have <br />to be widened. He stated whenever improvements are done in City or County right-of-way there <br />has to be an agreement on who will maintain it, and presumably this will be maintained by the <br />homeowner's association.
