CASE # <br /> <br /> PUBLIC HEARING <br />CONSIDER REVISIONS TO PROPOSED WETLAND BUFFER ORDINANCE; <br />CASE OF CITY OF RAMSEY <br /> By: Chris Anderson, Recycling & Zoning Coordinator <br /> <br />Background: <br /> <br />As you may recall, the May 5 Planning Commission agenda included a public hearing regarding <br />the proposed wetland buffer ordinance. Ordinance revisions reflecting the comments received at <br />the May 5 meeting have been incorporated into the draft. <br /> <br />Observations: <br /> <br />During the revision process, it came to StafFs attention that the proposed ordinance did not <br />include a structure setback from the buffer edge. This could pose a fire safety issue and/or <br />eliminate any usable yard on a particular lot. staff, const)lted with the Fire Marshall regarding <br />this matter and determined that a Setback of' some distance was necessary for fire safety <br />purposes. The Fire Marshall recommended a thirty (30) foot structure setback from the buffer <br />edge, Based on that recommendation and discussions with the Environmental Policy Board, <br />Staff is proposing a minimum structure setback from a buffer edg.e_ of fifteen (15) feet. <br /> <br />Both the Environmental Policy Board and City Staff felt that the'l'nclusion of a structure setback <br />was a significant enough change from the draft presented at the public hearing on May 5 that it <br />was appropriate to bring the proposed ordinance back to the.Planning Commission prior to its <br />introduction to City Council. <br /> <br />The following items are enclosed: <br /> <br />Draft ordinance <br />Flow chart outlining the wetland inventory and mapping process and ordinance <br />application process when an application for subdivision is received.. <br /> <br />Recommendation: <br /> <br />Both the Environmental Policy Board and City Staff recommend that the Planning Commission <br />forward the proposed ordinance to City Council for adoption. <br /> <br />Commission Action: <br /> <br />Motion by Commissioner and seconded by Commissioner <br />that City Council adopt the proposed wetland buffer ordinance. <br /> <br />to recommend <br /> <br />Review Checklist: <br /> <br />Copies To: <br /> <br />Asst.
