"Incidental" wetlands that are exempt from WCA regulation under <br />Minn. Rules 8420.0122 are not subject to the provisions of this <br />Section. <br /> <br />Temporary impacts from utility installation or maintenance that are' <br />exempt from WCA regulation under Minnesota Rules 8420.0122 are <br />not subject to the provisions of this Section. <br /> <br />If an applicant disputes the management classification of a wetland," <br />the applicant shall have the burden to supply detailed information for <br />review supporting the applicant's assertion, including but not limited <br />to, topographic, hydrologic, floristic and/or soil data deemed necessary <br />to determine its management classification. If the City is convinced by <br />evidence submitted by an applicant that a-wetland on the municipal <br />Wetland management classification map has been. incorrectly mapped <br />or has been misclassified, the map will be changed to reflect the <br />necessary corrections. All such corrections are subject to City Council <br />approval. <br /> <br />If an applicant questions the exact bot~ndary of a wetland, the <br />jurisdictional status of a wetland, or whether a wetland exists, they <br />shall have the burden to supply detailed information, for review by the <br />LGU, supporting the applicant's assertion, including but not limited to, <br />topographic, hydrologic, floristic and/or soil data deemed necessary. <br /> <br />9.26.1)4 General Standards. The following standards apply to all 'lands within <br />and/or abutting a wetland: <br /> <br /> Subj. 1. Septic and soil absorption systems must be setback a minimum <br />of seventy-five (75) feet from the City approved boundary of the wetland. <br /> <br /> Subd. 2. The MPCA's Best Management Practices shall be followed for <br />the construction of wetland protection methods and related improvements. <br /> <br />9.26.1}5 <br /> <br />Wetland Buffer Strips <br /> <br /> Subj..1. A wetland buffer strip shall be maintained abutting all wetlands <br />on new lots of record created after [date of ordinance]. Lots of record in existence on <br />[date of ordinance] are not subject to the buffer requirements set forth in this Section. At <br />the time a final plat is to be recorded, the developer shall also record a notice of the <br />wetland buffer requirement and prohibited activities against the title to the lot with the <br />office of the Anoka County Recorder. Befo/:e the City issues a building permit for a lot <br />with a required wetland buffer, the developer shall: <br /> <br /> a.
