Councihnember Cook introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-05-148 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0721 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FROM JAMES AND CHERI <br />WALLER TO EXCEED SIZE RESTRICTIONS FOR ACCESSORY BUILDING SPACE <br />ON A PROPERTY BETWEEN 14,880 AND 43,559 SQUARE FEET. <br /> <br /> WHEREAS, James and Cheri Waller, hereinafter referred to as the "Applicants", have <br />properly applied for a Conditional Use Permit to exceed the maximum amount of square footage <br />for accessory buildings on properties between 14,880 and 43,559 square feet as established in <br />section 9.11.02 "Accessory Uses" of City Code on the property generally known as 17937 <br />Fluorine St NW and legally described as follows: <br /> <br />Lot 5, Block 7, Ford Brook Estates, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That the Applicants appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on May 5, 2005, and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated by <br />reference. <br /> <br />2. That the Subject Property is zoned R-1 Residential - Rural Developing and is located outside <br /> the Metropolitan Urban Service Area (MUSA). <br /> <br />3. That the Subject Property is surrounded by properties also zoned R-1 Residential-Rural <br /> Developing. <br /> <br />4. That the Subject Property is approximately 0.85 acres in size. <br /> <br />5. That City Code restricts the Subject Property to a total of 1,488 square feet of accessory <br /> building space. <br /> <br />That the Applicants have a primary garage of 528 square feet; the proposed accessory <br />building would be 1,120 square feet in size; resulting in a total of 1,648 square feet of <br />accessory building space on the Subject Property and an overage of 160 square feet of <br />accessory building space. <br /> <br />That the Applicants have stated that the reason for the excess size of the proposed building is <br />to store private-use vehicles, equipment and other personal property, which is currently stored <br />outside on the Subject Property. <br /> <br /> <br />
