Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #21-095 <br />RESOLUTION APPROVING DRAINAGE AND UTILITY EASEMENT <br />ENCROACHMENTS FOR EAVE OVERHANGS IN THE PRESERVE AT NORTHFORK <br />WHEREAS, BK Land Development LLC, hereafter referred to as "Developer", has requested approval <br />of an easement encroachment up to a one (1) foot into drainage and utility easements for the lots commonly known <br />as 8876, 8864, 8862, 8856, 8854, 8850 and 8861 151St Lane NW, Ramsey, Minnesota, and legally described as: <br />Lots 5 — 10 (inclusive), Block 4, and Lot 6, Block 3, Preserve at Northfork, Anoka County, <br />Minnesota <br />(the `Subject Properties'); <br />WHEREAS, the City of Ramsey reviewed and approved the easement encroachment agreement on <br />March 9, 2021 subject to City Attorney and City Engineer approval. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, <br />ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Ramsey City Council hereby approves an Easement Encroachment Agreement authorizing up to <br />a one (1) foot easement encroachment of eave overhangs into the five (5) foot wide, side yard drainage <br />and utility easements on the Subject Properties subject to City Attorney and City Engineer approval and <br />execution of a signed encroachment agreement between Developer and City. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember , and <br />upon vote being taken thereon, the following voted in favor thereof: <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this 9th day of <br />March, 2021. <br />Mayor <br />ATTEST: <br />City Clerk <br />
