Recommendation: <br /> <br />The Planning Commission recommended that the City Council deny the preliminary plat and site plan <br /> <br />for the following reasons: <br /> <br />1) Density too high <br />2) Concerned with the amount of traffic on a long cul-de-sac <br />3) Uncertainty of how Potassium Street is going to be resolved <br />4) Want to see density transition applied to the development <br /> <br />Observations Continued: <br /> <br />On May 10, 2005, the City Council reviewed and tabled action on the plat and site plan. due to <br />unresolved issues related to Potassium Street. The City Council directed staff to attempt to contact all <br />property owners in addition t o those referenced above, affected by the PotassiUm Street right-of-way <br />acquisition. Those .property owners are Terry and .Mary Lamont, David and Jean Mort, and Milt <br />Weichelt. Staff sent letters to the property o.wners-and met.with them on May 23 and June 1,- <br />respectively. None of these property owners are in favor of the project. -The parties do reluctantly agree <br />that if Potassium Street must be upgraded, that its right-of-way be split 33 feet on the Shadetree Property <br />and 33 feet on their property. The Lamonts seem to be most directly affected by the taking as the present <br />plan would require removal of significant natural screening, including trees on their property and <br />possibly affect their on-site sewage system. <br /> <br />On June 14, 2005, the City Council considered the preliminary plat and site plan of the proposed <br />development..Concerns were raised by the City Council regarding the cul-de-sac length and number of <br />units. The City Council tabled action on the preliminary plat and site plan and directed Staff to bring <br />back findings in regards to the preliminary plat for the City Council to consider when making a decision <br />on the development. <br /> <br />On June 28, 2005, the City Council table action on the plat and site plan until July 12, 2005. <br /> <br />Finally, would like to inform the Council that the 120-day period allowed for preliminary plat approval <br />under State Statute will expire on August 5, 2005. <br /> <br />Council Action: <br /> <br />Motion to approve Resolution #05-06-__ <br />preliminary plat of Rum River Estates. <br /> <br />-and- <br /> <br />Motion to approve Resolution #05-06- <br />based on Findings of Fact # <br /> <br />Motion to approve Resolution #05-06- <br />based on Findings of Fact # <br /> <br />adopting Findings of Fact # <br /> <br />regarding the <br /> <br />approving the preliminary plat of Rum River Estates, <br /> <br />denying the preliminary plat of Rum River Estates, <br /> <br />-131- <br /> <br /> <br />
