-240- <br /> <br />Property history. Condensed version <br /> <br />Early 1976.., a moratorium for what is known then as the 1990 urban area.., basica~ ~t,~ <br />in the city East of Sunfish Lake Blvd, and also South of 153rd Avenue, (now A/pine Drive), the <br />property in question is in the moratorium. The end result is a set of zoning criteria, and 2 special <br />zoning designations, UMB-1 and UMB-2. The property in Question was designated UMB-2. <br /> <br />The restrictions on expansion of the Commercial Buildings on the Property caused the owner to <br />put the property up for sate, and I purchased it, after the business 'equipment was removed, and <br />installed my contracting operation on the property and in the business building in Dec 1978. <br /> <br />In Jan 1979, I was appointed to the P and Z commission. Some of the Hardship I have now is a <br />direct result of being a member of the P and Z during some of the actions the City Council took. <br /> <br />June 1983, city council deletes the entire UMB class of zoning in the city. Then later in the year <br />applies the R3-U zone to my property, as there is no business zone suitable for the location. <br /> <br />June t989 City commences Legal action to Un-grandfather the Commercial rights of the <br />property. This action was dismissed in November of 1990, when the judge informed the city that <br />I was ready to proceed to'trial} and further delays to negotiate conditions was not needed. Also <br />the judge stated that he was prepared to rule in my favor, because I had pro,tided documents <br />showing I has standing. There is no court record because of the dismissal of the case.. I <br />purchased a copy of the cities documentation of the case at that time... (m 12-m33). Some of <br />these documents survived the 1992 fire. " <br /> <br />June 1981. Make a handshake agreement with my neighbors, Mr and Mrs Hanus to buy the 37 <br />foot driveway access when that portion of Woodpond Hills becomes available for sale. <br /> <br />March 1992. Residential structure bums to the ground. <br /> <br />March 1.992. Building official gives a letter stating that because the loss is 100 percent the <br />private septic will have to be brought to current state standards before occupancy of the rebuilt <br />residence is allowed. <br /> <br />April 1992. Submit petition for City sewer services, to happen concurrent with Woodpond Hills <br />subdivision that Summer. The petition gets misplaced with the petition of my EXwife and the <br />petition of Pondvale residents for city services. Pondvale gets services, I do not. <br /> <br />Feb 1993. Insurance settles claim by purchasing a replacement property for the residential loss. <br /> <br />April 1993. Petition for improvements gets resubmitted properly' for extension of City Sewer to <br />the property. <br /> <br />July 1993.' A letter from the city that the business is now un-grandfathered because of the loss <br />sustained by the fire of 1992. This persists for 6 years and a court appearance in 1999, where the <br />court left the property grandfathered, but order a general cleanup to residential standards of the <br />things being stored outside on the property. <br /> <br />April 1994. Assessment for installed sewer and water services begin. <br /> <br />Sept 1996. Close on the purchase on the lot next to my property on the south to gain the area <br />needed to build an 8 unit Rental structure on the properties, <br /> <br /> <br />
