-244- <br /> <br />Chairman Peterson informed the audience that this recommendation will now <br />go before Council for their approval. <br /> <br />The Planning and Zoning Commission recessed at 9:50 p.m. <br /> <br />Commissioner LaDue dismissed himself from the meeting at this time. <br /> <br />Chairman Peterson called the meeting back to order at 10:05 p.m. <br /> <br />Case ~5.: · Development Of The Five Year Capital Improvement Program BUdget (CtPB): <br /> <br />Chairman Peterson stated that he a~d Cdmmissioners Deemer and Zimmerman attended <br />the CIP workshop. The workshop presentation dealt with those items spelled <br />out in tonight's P&Z agenda and in addition, Mr. Schnelle added Personnel Needs. <br /> <br />Chairman Peterson stated that he needs two other members from P&Z to work with <br />him on the C~PB and this' will entitle meeting with City St~ff, Public Works <br />people, ~ark Commission and Police personnel. He further commented that the <br />CIPB should be submitted to Council by the end of November or the first part <br />of December. <br /> <br /> Commissioners Zimme~nan and Deemer volunteered to work with Chairman Peterson <br /> and City Administrator Schnelle on the CIPB. <br /> <br />MISCELLANEOUS .. <br /> <br />Mr. Schnelte stated that one item for Council discussion at their special meeting <br />of August 15, 1983 will be site and design plan ordinances. Council has eased <br />up during the recessionary period, some plats have received extensions in time <br />and now that the recession is over these plats should be reviewed and all site <br />and design plans should be treated equally. <br /> <br />Case #6: Review Of AIl ~ 2 Zoning Designators: <br /> <br />~.~. Schnelte stated that there are 3 parcels of land zoned UMB 2. ~en the <br />City was rezoned these three parcels were grandfatherad in as existing businesses <br />in a residential area and were zoned UMB 2 because the City did not want to <br />rezone the entire area U~ which would have allowed some uses in these areas that <br />the City did not want. The issue has come up and there should be definite <br />control on it in regards to what 'those individual property owners can do with <br />· ~heir property. <br /> <br />Commissioner Deemer stated that the three parcels involved are his property, <br />Lee's Landscaping and Bill Aydt's property (which contains the body shop). <br />Commissioner Deemer stated that his understaning of the situation was that the <br />only uses that would be allowed on these properties were those uses in existence <br />when the properties were grandfathered in. and rezoned US~ 2, and further that <br />expansion of these same businesses would not require variances. <br /> <br />Mr. Berg noted that Bill Aydt's property has been rezoned US~ and no e:cpansion <br />is allowed per the conditional use agreement. <br /> <br />Commissioner De=_Jner stated that what he w~nts for his property ~Ad Lee's <br />Landscaping is one specific use, and e~_~ansion of that use not requiring a <br />v~=riance and if usa ceases, the property be rezoned to residential. Commissioner <br />Deemer stated that he rea~_!y believe .this 'was the intent of the City also, but <br />it was ~itten incorract!y in the ordinance and never corrected. <br /> <br /> <br />
