CONSIDER THE ACQUISITION OF PROPERTY FOR <br />PARK AND TRAIL PURPOSES <br /> By: Steven J. Jankowski, City Engineer <br /> <br />CASE # q <br /> <br />Background: <br /> <br />The City desires obtaining a one acre parcel which lies between TH 47 and County Ditch 3 north <br />of 160th Lane and Elmcrest Park for the purpose of constructing-a pedestrian trail access to the <br />park from the south. Staff has been directed to attempt to acquire this property through <br />negotiations with Mr. Lynn Mortenson, the property owner. The following is a brief recap of the <br />efforts undertaken by the City towards this acquisition: <br /> <br />· November 2004 the CitY hired Watson Appraisal and ConSultant Service to prepare an <br /> appraisal of the property. Th~ appraisal was received on December 3, 2004. The county <br /> assessed value of this property is $6,500. <br />· On February 14, 2005 staff presented the landowner with an offer in the. appraised <br /> amount orS1,000 and advised of the fight to obtain an independent appraisal at City <br /> expense. · .. <br />· On March 10, 2005 the property owner made a counter offer of 2005 in the amount of <br /> $31,500. <br />· On April 12, 2005 the City Council rejected the owner's counteroffer and authorized the <br /> use of eminent domain, but directed staff to continue negotiations with the property <br /> <br />owner. <br /> <br />Staff has received a verbal a~eement with Mr. Mortenson to acquire this property for $11,000 <br />which is within the guidelines provided to staff for the acquisition ofth/s property. <br /> <br />Recommendation: <br /> <br />Staff recommends that the committee recommend to the City Council acceptance of the amount <br />of $11,000 for the acquisition of this approximate one act6 parcel for park and trail purposes. <br /> <br />Action: <br /> <br />Motion to recommend to the City Council acceptance of .the amount of $11,000 for :the. <br />acquisition of this approximate 6ne acre parcel for.park and trail'purposes.. <br /> <br />Reviewed By: <br />Public Works Director/Fire Chief <br />Assistant Public Works Director/Principal Engii~eer <br />City Attorney <br /> <br />PW: 06/21/05 <br /> <br />_37927 <br /> <br /> <br />
