<br />Councilmember Musgrove introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #21-099 <br /> <br />RESOLUTION TERMINATING THE JOINT POWERS FIRE PROTECTION <br />AGREEMENT BETWEEN THE CITY OF RAMSEY AND THE CITY OF NOWTHEN <br /> <br /> WHEREAS, <br />Ramsey and Nowthen entered into a Joint Powers Fire Protection Agreement <br />in 2009 (“the JPA”) for the purpose of cooperating to provide fire and rescue services in portions <br />of Ramsey and all of Nowthen; and <br /> <br />WHEREAS, <br />the JPA contains a provision by which one party can terminate the JPA with <br />two years’ written notice; and <br /> <br />WHEREAS, <br />Ramsey provided Nowthen with written notice of termination in December <br />2019, with an effective termination date of December 31, 2021; and <br /> <br />WHEREAS, <br />following extensive discussions, the parties agree that that termination can <br />be moved up to the effective date of this Agreement. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> <br />1)Notwithstanding any terms to the contrary in the JPA, and notwithstanding the date of <br />Ramsey’s termination notice to Nowthen, the parties agree that the JPA is and shall be <br />terminated as of the effective date that the Governor of the State of Minnesota signs <br />into law the special legislation that is pending before the Minnesota State Legislature <br />concerning the Ramsey Volunteer Firefighters’ Relief Association. In the event that <br />the special legislation, as agreed to by the parties and submitted to the State Legislature, <br />be amended by the State Legislature or not signed into law by the Governor, the JPA <br />will not be considered terminated and the parties retain their respective rights under the <br />JPA. <br /> <br /> <br />2)The parties agree that the disposition of assets and personnel is resolved to each <br />party’s satisfaction, subject to the special legislation pending before the Minnesota <br />State Legislature concerning the Ramsey Volunteer Firefighters’ Relief Association. <br /> <br /> <br />3)Notwithstanding any terms to the contrary in the JPA, as of April 26, 2021, the parties <br />agree that City of Ramsey and the Ramsey Fire Chief shall no longer have operational <br />control of fire and rescue operations within the boundary of the City of Nowthen. Such <br />operational control of fire and rescue operations within the City of Nowthen shall be <br />vested in the City of Nowthen and the Nowthen Fire Chief. <br /> <br /> <br /> <br />
