<br />Councilmember Woestehoff introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #21-095 <br /> <br />RESOLUTION APPROVING DRAINAGE AND UTILITY EASEMENT <br />ENCROACHMENTS FOR EAVE OVERHANGS IN THE PRESERVE AT <br />NORTHFORK <br /> <br /> WHEREAS, <br />BK Land Development LLC, hereafter referred to as “Developer”, has <br />requested approval of an easement encroachment up to a one (1) foot into drainage and utility <br />st <br />easements for the lots commonly known as 8876, 8864, 8862, 8856, 8854, 8850 and 8861 151 <br />Lane NW, Ramsey, Minnesota, and legally described as: <br /> <br />Lots 5 – 10 (inclusive), Block 4, and Lot 6, Block 3, Preserve at Northfork, Anoka <br />County, <br />Minnesota <br /> <br />(the ‘Subject Properties’); <br /> <br /> WHEREAS <br />, the City of Ramsey reviewed and approved the easement encroachment <br />agreement on March 9, 2021 subject to City Attorney and City Engineer approval. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the Ramsey City Council hereby approves an Easement Encroachment Agreement <br />authorizing up to a one (1) foot easement encroachment of eave overhangs into the five <br />(5) foot wide, side yard drainage and utility easements on the Subject Properties subject <br />to City Attorney and City Engineer approval and execution of a signed encroachment <br />agreement between Developer and City. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Howell, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Kuzma <br /> Councilmember Woestehoff <br /> Councilmember Howell <br /> Councilmember Heineman <br /> Councilmember Musgrove <br /> Councilmember Riley <br /> Councilmember Specht <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br /> <br />
