said line, thence southerly to a point on northeasterly line of said highway, which point <br />is 400 feet from point of beginning and said line there terminate, subject to easement. <br /> <br />(the "Subject Property"); and <br /> <br />WHEREAS, the Planning Commission met on April 3, 2014, conducted a public hearing <br />and recommended that the City Council approve the request to utilize an alternative surfacing <br />material for an expansion of the outdoor sales/display area on the Subject Property until such time <br />that the Subject Property is acquired for improvements to Highway 10 as identified in the <br />Minnesota Department of Transportation's (MnDOT) Highway 10 Access Management Plan or <br />Highway 10 Access Planning Study or for a term of five (5) years from the date that MnDOT <br />determines that the Subject Property will not be impacted by those future Highway 10 <br />improvements; and <br /> <br />WHEREAS, the City Council met on April 22, 2014 to review the request for an interim <br />use permit to utilize an alternative surfacing material for an expansion of the outdoor sales/display <br />area on the Subject Property. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />This permit is issued pursuant to Section 117-52 of the Ramsey City Code. The conditions of this <br />interim use permit are as follows: <br /> <br />1) Based on Findings of Fact #0926, an Interim Use Permit ("Permit") to utilize an alternative <br />surfacing material for expansion of the outdoor sales/display area on the Subject Property is <br />hereby granted to M & G Trailer Sales and Service ("Permittee"). <br /> <br />2) The term of the Permit shall commence on April 22, 2014 and shall expire upon the acquisition <br />of the Subject Property for Highway 10 improvements identified in MnDOT's Highway 10 <br />Access Management Plan or Highway 10 Access Planning Study, or five (5) years after the <br />date that MnDOT determines the Subject Property will not be impacted by those Highway <br />10 improvements. <br /> <br />3) This Permit is applicable only to the expansion of the existing, paved parking lot on the <br />Subject Property with an alternative surface material. The granting of this Permit does not <br />allow for any other use that is prohibited in the H-1 Highway 10 Business District. <br /> <br />4) The Permittee shall ensure that customer and employee parking remains in compliance with <br />the underlying H-1 Highway 10 Business District standards. <br /> <br />5) Should the area of disturbance on the Subject Property be one (1) acre or larger in size, the <br />Permittee shall be responsible for obtaining a permit from the Lower Rum River Water <br />Management Organization (LRRWMO) and shall provide a copy of said permit to the City. <br />If applicable, Permittee shall furnish a copy of the LRRWMO permit to the City prior to <br />commencement of any land disturbance activities on the Subject Property. <br /> RESOLUTION #14-04-068 <br />Page 2 of 5 <br /> <br />
