Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #21-132 <br />A RESOLUTION AUTHORIZING ABATEMENT AND <br />CODE ENFORCEMENT PROCESS FOR 6225 RIVLYN AVE NW <br />RECITALS <br />1. The property owner Jessica Kidd (listed as Jessica Kiel at County) (the "Property Owner") <br />has an open code enforcement case on the property generally known as 6225 Rivlyn Avenue <br />NW and legally described as follows: <br />AUD SUB NO 96 THAT PART OF LOT 26 AUD SUB NO 96 ANOKA CNTY, MN <br />DESC AS COMM ATTHE POINT OF INTERSECTION OF THE NLY LINE OF <br />RIVLYN AVE AS LAID OUT IN THE PLAT OF DICKENSONS, Anoka County, MN <br />(the "Subject Property"); and <br />2. The Subject Property is zoned R-1 MUSA and is approximately 0.31 acres in size; and <br />3. There are documented code enforcement cases dating back to 2008, 2009, 2011, 2017, 2018, <br />and 2019 on the Subject Property for outdoor storage, off-street parking violations, and <br />nuisance issues; and <br />4. The City has most recently opened a case on the Subject Property for violations related to <br />off-street parking and public nuisance items; and <br />5. Most recently, the City sent a formal first notice of violation on July 7, 2020, a second notice <br />of violation on September 29, 2020, and a third notice of violation on April 20, 2021; and <br />6. The Nuisance Regulations in the City Code (Chapter 30) prohibit the outdoor storage of junk, <br />debris, items that are not being put to their intended use, construction debris, and other <br />stockpiles of materials; and <br />7. City Code Section 117-355 prohibits more than 6 items on the Subject Property, prohibits <br />vehicles stored on the grass, and outlines allowable parking on the Subject Property; and <br />8. Actions to date include: <br />a. July 7, 2020 - The City sent first formal notice via US Mail <br />b. August 4, 2020 — The City spoke to the property owner who said they were making <br />progress and inspection scheduled for August 12, 2020. <br />c. August 19, 2020 - Inspection was attempted for property. Owner and husband were <br />present, but did not allow Staff to take photos of the property. There were many <br />public nuisance issues behind the fence. Requested a reinspection one week from <br />today. <br />d. September 23, 2020 — Inspection of the property, slight progress was made, but <br />photos were not allowed to document progress. Owner stated home is a triplex.
