C. The City will not offer counseling services to any officer involved in a <br />critical incident if the City's Workers Compensation provider agrees to <br />pay for menial health services arising out of the same oritical inoident. <br />D. A1l counseling servioes offered pursuant to this agreementmust beutilized <br />within two years of an officer's involvement in a critical incident, <br />E. The offieer may attend counseling appointments while on -duty, without <br />using acorued paid leave time. <br />3, Financial Liniitations. The City will pay up to a maximum of $2,500 towards <br />any counseling service for an individual officer involved in a critical incident if <br />an individual officer chooses to receive additional counseling, that officer is <br />responsible forpaying for such counseling. <br />4. Authorization Required, As a condition of receiving counseling services <br />pursuant to this agreement, an officer thustbring a signed note from the counselor <br />to inform the City's Human Resources Manager of the date and time the officer <br />received such services. <br />5. Relationship with Counselor. It is the parties' intention that any offioer who <br />seeks counseling services pursuantto this .Agreement will be consideredto he the <br />patient or the client of the individual or entity selected to provide those services, <br />regardless of the Citys frnancial contribution inwards the cost of suohservioes. <br />6. Data Privacy. All data collected, created, received, maintained, or disseminated <br />by the City pursuant to this Agreement shall be classified pursuant to the <br />Minnesota Government Data Practices Act, The City acknowledges and agrees <br />that, to the extent that it provides data to the individual or entity selected to <br />provide counseling services, its oontract with such individual or entity is <br />governed by Minnesota Statutes, section 13,05, subdivision 6. <br />• <br />City Adiainistrator <br />Date <br />Date <br />19 <br />
