CC Regular Session 5, 8, <br />Meeting Date: 05/25/2021 <br />By: Brian McCann, Community <br />Development <br />Information <br />Title <br />Adopt Resolution #21-098 Approving Abatement of 7111 175th Ave NW (Case of Tracy Phillippi) <br />Purpose/Background: <br />The City Council previously granted a 30 Day Extension to this Notice of Violation. The Property is not in <br />compliance and Staff is again seeking authorization for abatement. <br />Planning is seeking authorization to abate the items in violation of City Code at 7111 175th Ave NW. The Subject <br />Property has exceeded the number of allowed vehicles, and vehicles parked on the grass, as regulated by Section <br />117-355. There are other public nuisance items in violation of Chapter 30 and Section 117-111 of City Code in <br />relation to construction materials, and fences, respectively. City Council granted a thirty (30) day extension to <br />resolve the violations on site at their April 13th, 2021 regular meeting, but violations are still present on the Subject <br />Property. <br />Notification: <br />No notification is required. <br />Observations/Alternatives: <br />Summary: <br />• There have been at least four (4) code enforcement cases on the Subject Property since 2011 with multiple <br />violations per case <br />• Most recent violation case was forwarded on January 15, 2021 from the Police Department regarding number <br />of vehicles and junk on the property. <br />• A first notice of violation for off-street parking, fence, and refuse violations was sent on January 15, 2020 <br />after a drive -by inspection was conducted. <br />• A second notice of violation for off-street parking, fence, and refuse violations was sent on March 2, 2021. <br />An administrative citation of $75 was included with the letter. <br />• No contact has been established with the property owner regarding the condition of the Subject Property, but <br />they paid their administrative citation via mail on April 8, 2021. <br />• The Property Owner was granted an extension of thirty (30) days to resolve the violations by the City <br />Council at their regular meeting on April 13, 2021. <br />• As of May 17th, 2021, there are still active violations on site for off-street parking, public nuisance items, <br />and a fence permit has not been applied for. <br />Funding Source: <br />Staff handles all Code Enforcement cases as part of their regular duties. <br />Recommendation: <br />Staff recommends motion to adopt Resolution #21-098 approving an abatement of 7111 175th Ave NW to remove <br />items in violation of City Code including the fence without a permit, unused construction materials, other refuse <br />items, and vehicles until six (6) vehicles remain on the property. The cost of the work will be assessed to the <br />Property Taxes for the Subject Property. <br />
