Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #21-142 RESOLUTION ALLOWING REMOVAL OF BERM AT 14601 RAMSEY BLVD NW AND ADAJCENT PROPERTY WHEREAS, Kinghorn Construction (the "Applicant") has requested that the City allow for the removal of a berm at the properties generally known as 14601 Ramsey Blvd NW and PID 27-32-25-32-0008 which are legally described as Lot 1, Block 1, and Outlot A, AEC Energy Park, Anoka County, MN, respectively (the "Subject Properties") ; and WHEREAS, the City of Ramsey approved the project at 14601 Ramsey Blvd NW for Connexus Energy in 1995 with options for screening of their outdoor storage area which included a berm; and WHEREAS, Kinghorn Construction is working on a proposed project for Outlot A, and the berm significantly expands onto the property, impacting buildability; and WHEREAS, Connexus Energy has an outdoor storage area that is fenced in and would be approved without the berm today; and WHEREAS, Staff finds that any building on Outlot A would additionally screen the outdoor storage area; and WHEREAS, Connexus Energy owns both properties and is supportive of the application; and WHEREAS, the City Council reviewed the proposed request on May 25, 2021 and approved of the berm removal. NOW THEREFORE, BE IT RESOLVED BY THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That they approve removal of the berm on the Subject Properties contingent upon: a. Final review and approval by the City Engineer and City Attorney b. Compliance with all applicable state and local code requirements, including any permits necessary for removal of the berm c. Staff inspection of the outdoor storage area on Connexus Energy's site, and making any reasonable recommendations for the outdoor storage area, including if needed, additional fencing or opaque covers added to the fencing.
