<br />Councilmember Musgrove introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #21-142 <br /> <br />RESOLUTION ALLOWING REMOVAL OF BERM AT 14601 RAMSEY BLVD NW AND <br />ADAJCENT PROPERTY <br /> <br />WHEREAS, Kinghorn Construction (the “Applicant”) has requested that the City allow <br />for the removal of a berm at the properties generally known as 14601 Ramsey Blvd NW and PID <br />27-32-25-32-0008 which are legally described as Lot 1, Block 1, and Outlot A, AEC Energy Park, <br />Anoka County, MN, respectively (the “Subject Properties”) ; and <br /> <br />WHEREAS, the City of Ramsey approved the project at 14601 Ramsey Blvd NW for <br />Connexus Energy in 1995 with options for screening of their outdoor storage area which included <br />a berm; and <br /> <br />WHEREAS, Kinghorn Construction is working on a proposed project for Outlot A, and <br />the berm significantly expands onto the property, impacting buildability; and <br /> <br />WHEREAS, Connexus Energy has an outdoor storage area that is fenced in and would be <br />approved without the berm today; and <br /> <br />WHEREAS, Staff finds that any building on Outlot A would additionally screen the <br />outdoor storage area; and <br /> <br />WHEREAS, Connexus Energy owns both properties and is supportive of the application; <br />and <br /> <br />WHEREAS, the City Council reviewed the proposed request on May 25, 2021 and <br />approved of the berm removal. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That they approve removal of the berm on the Subject Properties contingent upon: <br />a. Final review and approval by the City Engineer and City Attorney <br />b. Compliance with all applicable state and local code requirements, including any <br />permits necessary for removal of the berm <br />c. Staff inspection of the outdoor storage area on Connexus Energy’s site, and making <br />any reasonable recommendations for the outdoor storage area, including if needed, <br />additional fencing or opaque covers added to the fencing. <br /> <br /> <br /> <br /> <br />
