Ms. Nowtck noted that besides the sidewalks connecting the individual entries, there will be seven connections to the County trail, as opposed to 44 to 50 connections from individual units. Commissioner I.evine indicated that from a residential standpoint, that is private area versus the regional trail, which is public. He stated if he was living there he would want that separation. City I';nginccr Linton stated Bunker is slated as four lanes in 2007. He indicated that he feels if there is going to be a private sidewalk for these residents it should be on the property, and not in the County right-of-way. Vice Chairperson Johnson advised that the regional trail will be maintained by the City; however thc County will give license to the association for the sidewalk. He indicated the license implies no right to real estate, and will say the association will maintain the sidewalk, and the County can reclaim that property at any time, with notice. City l';ngincer Linton stated the other concern is that this extra thirty feet of right-of-way is not present on the remainder of Town Center property abutting Bunker Lake Boulevard, so fair to other developers who will not have this option. Commissioner Brauer indicated if they can deal with the terms and license from the County, and make it clear this is a one-time deal because of the presence of extra right-of-way, they should be able to approve it. Mr. Voss stated he will commit to limiting this request from Ramsey Boulevard to Town Center Drive. l lc indicated to the west of Town Center Drive it will go back to the regular right-of-way. Motion by Commissioner Levine, seconded by Commissioner Shepherd, to close the public hearing at 7:55 p.m. Motion Carried. Voting Yes: Assistant Chairperson Johnson, Commissioners Levine, Shepherd, Braucr, and Van Scoy. Voting No: None. Absent: Chairperson Nixt, and Commissioner Watson. Commission Business Commissioncr Van Scoy stated that as far as utilization of the right-of-way is concerned, the Cotmty has the final say. Vice Chairperson Johnson agreed, but indicated the City could say no, cvcn il' thc County granted the encroachment. C(m~misskmer Van Scoy noted that they went from a density of 12.6 to 11.6, and are shooting for 15 units per acre. Assistant Community Development Director Frolik indicated that as they get to the core of the Town Center they will see condo flats, or stacked units, which will increase the overall density.
