Ms. Nowtck noted that besides the sidewalks connecting the individual entries, there will be <br />seven connections to the County trail, as opposed to 44 to 50 connections from individual units. <br /> <br />Commissioner I.evine indicated that from a residential standpoint, that is private area versus the <br />regional trail, which is public. He stated if he was living there he would want that separation. <br /> <br />City I';nginccr Linton stated Bunker is slated as four lanes in 2007. He indicated that he feels if <br />there is going to be a private sidewalk for these residents it should be on the property, and not in <br />the County right-of-way. <br /> <br />Vice Chairperson Johnson advised that the regional trail will be maintained by the City; however <br />thc County will give license to the association for the sidewalk. He indicated the license implies <br />no right to real estate, and will say the association will maintain the sidewalk, and the County can <br />reclaim that property at any time, with notice. <br /> <br />City l';ngincer Linton stated the other concern is that this extra thirty feet of right-of-way is not <br />present on the remainder of Town Center property abutting Bunker Lake Boulevard, so fair to <br />other developers who will not have this option. <br /> <br />Commissioner Brauer indicated if they can deal with the terms and license from the County, and <br />make it clear this is a one-time deal because of the presence of extra right-of-way, they should be <br />able to approve it. <br /> <br />Mr. Voss stated he will commit to limiting this request from Ramsey Boulevard to Town Center <br />Drive. l lc indicated to the west of Town Center Drive it will go back to the regular right-of-way. <br /> <br />Motion by Commissioner Levine, seconded by Commissioner Shepherd, to close the public <br />hearing at 7:55 p.m. <br /> <br />Motion Carried. Voting Yes: Assistant Chairperson Johnson, Commissioners Levine, Shepherd, <br />Braucr, and Van Scoy. Voting No: None. Absent: Chairperson Nixt, and Commissioner <br />Watson. <br /> <br />Commission Business <br /> <br />Commissioncr Van Scoy stated that as far as utilization of the right-of-way is concerned, the <br />Cotmty has the final say.
