Councilmember Woestehoff introduced the following resolution and moved for its adoption: <br />RESOLUTION #21-064 <br />RESOLUTION APPROVING AN EASEMENT ENCROACHMENT AGREEMENT ON <br />MULTIPLE LOTS IN RIVERSTONE 5th ADDITION <br />WHEREAS, Riverstone Development LLC, hereinafter referred to as "Developer", has <br />requested up to a one (1) foot encroachment into ten (10) foot wide drainage and utility <br />easements (the "Easements") on the lots generally known as 8744, 8756, and 8788 151' Avenue; <br />15146, 15216, 15228, 15213, and 15225 Tiger Street; 15226 and 15214 Snowy Owl Street; and <br />15286, 15273, and 15275 Quintana Court NW, and legally described as follows: <br />Lot 1, Block 2 Riverstone 5th Addition <br />Lot 11, Block 4 Riverstone 5th Addition <br />Lot 2, Block 2 Riverstone 5th Addition <br />Lot 20, Block 4 Riverstone 5th Addition <br />Lot 7, Block 2 Riverstone 5th Addition <br />Lot 21, Block 4 Riverstone 5th Addition <br />Lot 1, Block 3 Riverstone 5th Addition <br />Lot 6, Block 7 Riverstone 5th Addition <br />Lot 11, Block 3 Riverstone 5th Addition <br />Lot 8, Block 8 Riverstone 5th Addition <br />Lot 12, Block 3 Riverstone 5th Addition <br />Lot 9, Block 8 Riverstone 5th Addition <br />Lot 10, Block 4 Riverstone 5th Addition <br />(the "Subject Properties"); and <br />WHEREAS, the City Council reviewed and approved the Easement Encroachment <br />Agreement on April 13, 2021. <br />NOW THEREFORE, BE IT RESOLVED BY THIS PLANNING COMMISSION OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council hereby grants approval of an Easement Encroachment <br />Agreement for the Subject Properties allowing up to a one (1) foot encroachment into the <br />Easements contingent upon: <br />a. There being no encroachment requests in the Riverstone South project. <br />b. Review and approval by the City Engineer and City Attorney to ensure that the <br />Easements can still function and be sufficiently maintained. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Howell, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Kuzma <br />Councilmember Woestehoff <br />Councilmember Howell <br />Councilmember Heineman <br />Councilmember Musgrove <br />Councilmember Riley <br />Councilmember Specht <br />
