<br />WHEREAS, it is suspected that an RV on the Property is being use as a residence which <br />is not a permitted use; and <br /> <br />WHEREAS, an administrative search warrant is necessary to completely and accurately <br />document all current City Code violations on the Subject Property; and <br /> <br />WHEREAS, upon reciept of an administrative search warrant, City Staff will complete an <br />inspection of the Subject Property, document all existing City Code violations, and initiate the City <br />Council approved process for code enforcement; and <br /> <br />WHEREAS, the Property Owner met with Staff on April 29, 2019 where Staff became <br />aware of an individual potentially living in an RV on the property; and <br /> <br />WHEREAS, the Property Owner declined voluntary inspection; and <br /> <br />WHEREAS, the City Council approved Resolution 19-096 granting a code enforcement <br />process and for Staff to seek a search warrant; and <br /> <br />WHEREAS, an inspection by Ramsey City Staff was conducted on June 6, 2019; and <br /> <br />WHEREAS, City of Ramsey Staff turnover has left the case unenforced; and <br /> <br />WHEREAS, City Staff inspected property from the road and sent a first letter on May 6, <br />2021 to the business and home on the Property; and <br /> <br />WHEREAS, City Staff attempted a second letter as a first notice of violation on May 21, <br />2021; and <br /> <br />WHEREAS, the Property Owner has not responded to previous attempts for an <br />inspection; and <br /> <br />WHEREAS, an administrative search warrant is necessary to completely and accurately <br />document all current City Code violations on the Subject Property; and <br /> <br />WHEREAS, upon reciept of an administrative search warrant, City Staff will complete an <br />inspection of the Subject Property, document all existing City Code violations, and initiate the City <br />Council approved process for code enforcement; and <br /> <br />FINDINGS OF FACT <br />1. That the City recognizes the lawful non conforming rights on the property and understands <br />those rights to be limited to the area identified in Exhibit A. <br /> <br />2. That any currently licensed and operable motor vehicles or items related to the Business <br />are limited to the area identified within Exhibit A. <br /> <br />RESOLUTION #21-168 <br />Page 3 of 5 <br /> <br />
