Recommendation:

Thc [)lanning Commission recommended that the City Council deny the preliminary plat and site plan
for the [bllowing reasons:
1) Density too high
2) Concerned with the amount of traffic on a long cul-de-sac
3) Uncertainty of how Potassium Street is going to be resolved
4) Want to see density transition applied to }he development

Obserwttions Continued:

On May 10, 2005, the City Council reviewed and tabled action on the plat and site plan due to
unresolved issues related to Potassium Street. The City Council directed staff to attempt to contact all
property owners in addition t o those referenced above, affected by the Potassium Street right-of-way
acquisition. Those property owners are Terry _and Mary Lamont, David and Jean Mott, and Milt
Weichclt. Staff sent letters to the property owners and met with them On May 23 and June 1,
respectively. None of these property owners are in favor of the project. The parties do reluctantly agree
that il' I'otassium Street must be upgraded, that its right-of-way be split 33 feet on the Shadetree Property
and 33 l'cet on their property. The Lamonts seem to be most directly affected by the taking as the present
plan would require removal of significant natural screening, including trees on their property and
possibly af't~ect their on-site sewage system.

On June 14, 2005, the City Council considered the preliminary plat and site plan of the proposed
development. Concerns were raised by the City Council regarding the cul-de-sac length and number of
units. The City Council tabled action on the preliminary plat and site plan and directed Staff to bring
back findings in regards to the preliminary plat for the City Council to consider when making a decision
o~t thc development. After discussion, the City Council, On July 12, 2005, tabled action on
consideration of the preliminary plat and site plan until the July 26, 2005 meeting.

t:inally, would like to inform the Council that the 120-day period allowed for preliminary plat approval
under State Statute will expire on August 5, 2005.

Council Action:

Motion to approve Resolution #05-06-__
pre lim inaty plat of Rum River Estates.

adopting Findings of Fact #

regarding the

-and-

Motion to approve Resolution #05-06-
based on Findings of Fact #

approving the preliminary plat of Rum River Estates,

-Or-

Motion to approve Resolution #05-06-
based on Findings of Fact #

denying the preliminary plat of Rum River Estates,
