Council member introduced the following resolution and moved for its adoption: RESOLUTION//05-07- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT #0 AND DECLARING TERMS OF PERMIT TO GRADE AND EXPORT SOILS WHEREAS, Findings olYFact #0 t'ollowing conditions. the Ramsey City Council adopted Resolution #05-07- adopting __ for this use and herein approves the Conditional Use Permit subject to the NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On July __, 2005, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to Eric Thomsen ("Permit Holder") for grading operations on the property legally described as follows: That part o[' the Southwest Quarter of the Southwest Quarter of Section 2, Township 32, Range 25, Anoka County, Minnesota, lying northerly of the centerline of Trott Brooks, subject to easement of record; -and- Thc Northwest Quarter of the Southwest Quarter of Section 2, Township 32, Range 25, Anoka County, Minnesota, lying southerly of County Road #63. ("Subject Property:") This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The conditions of this permit are as follows: 1. This permit shall expire ninety (90) days from the date of approval of this permit. 2. The exporting of material shall be subject to the City Engineer's approval and contingent on the following: Excavation area has been reshaped to a 4:1 slope. All but a maximum 5 acre excavation area is established with turf (phasing plan). 3. A plan showing the finished elevations shall be submitted to the City Engineer for approval by November 1, 2005. 4. The grading operations shall be conducted in accordance with the approved grading plan. 5. All equipment used for grading and hauling operations shall be maintained and operated in such a manner to minimize noise, dust, and vibrations adversely
