No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to the <br />lot is provided including the installation of at least one layer of bituminous surfacing; (b) all <br />utilities are in place, operational and accepted by the CITY; (c) for lots that have a slope of <br />less than 2%, a certificate of grading, prepared by a licensed (State of Minnesota), <br />prof'cssional land surveyor, must be provided to the City documenting that the flattest grade <br />on this lot is 1% or greater will require certificates of grading; and (d) boulevard sod and <br />landscape tree, or escrow for same, have been provided. <br /> <br /> SECTION III <br />PARK DEDICATION <br /> <br />10. Cash Contribution. The kamsey Meadows 5th Addition plat is located in the Prairie <br /> Recreation District. Park dedication requirements shall be satisfied by a cash payment. The <br /> Plat is creating 7 lots, which equates to a cash payment of $15,400 (7 lots x $2,200/iot). This <br /> payment shall be made to the City prior to the release of'the Final Plat for recording. <br /> <br /> SECTION IV <br />TRANSPORTATION AND LANDSCAPING <br /> <br />1 l. Trail Development And Fees. The City Council has enacted a trail development fee in the <br /> amount ol~ Four Hundred Seventy Five Dollars and no cents ($550.00) per unit, which <br /> equates to $3,850.00 due to satisfy trail development fees. This fee must be paid prior to the <br /> release of the final plat for recording <br /> <br />12. Tree, Shrub and Sod Planting Plan. The addition of trees,' shrubs and sod to the Plat shall <br />be in accordance with the approved Landscape Plan prepared by Rehbein Engineering dated <br /> The trees to be protected during construction must be identified on the grading <br /> blah, and the plan must require the installation of 'tree save fences' prior to land clearing or <br /> grading. In addition, the requirement for this Plan shall be fulfilled by the DEVELOPER. as <br /> fbllows: <br /> <br />a) <br /> <br />Minimizing the impact of construction on trees in accordance with Minnesota <br />Extension Service publication "Protecting Trees From Construction Damage" <br />(Publication #NR-FO-6135-S). <br /> <br />b) <br /> <br />For trees intended to be planted between the sidewalk and the street, the specific <br />locations must be staked in advance of planting and approved by the CITY. In the <br />event the weather is not conducive to tree or planting sod in the boulevard at the time <br />of Certificate of Occupancy, the Building Permit holder shall place a cash deposit in <br />the amount of $300.00 for trees and $300.00 for sod in an escrow account with the <br />CITY and upon verification of the planting being accomplished, said cash deposit <br />shall be refunded to the Building Permit holder.
