No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to the lot is provided including the installation of at least one layer of bituminous surfacing; (b) all utilities are in place, operational and accepted by the CITY; (c) for lots that have a slope of less than 2%, a certificate of grading, prepared by a licensed (State of Minnesota), prof'cssional land surveyor, must be provided to the City documenting that the flattest grade on this lot is 1% or greater will require certificates of grading; and (d) boulevard sod and landscape tree, or escrow for same, have been provided. SECTION III PARK DEDICATION 10. Cash Contribution. The kamsey Meadows 5th Addition plat is located in the Prairie Recreation District. Park dedication requirements shall be satisfied by a cash payment. The Plat is creating 7 lots, which equates to a cash payment of $15,400 (7 lots x $2,200/iot). This payment shall be made to the City prior to the release of'the Final Plat for recording. SECTION IV TRANSPORTATION AND LANDSCAPING 1 l. Trail Development And Fees. The City Council has enacted a trail development fee in the amount ol~ Four Hundred Seventy Five Dollars and no cents ($550.00) per unit, which equates to $3,850.00 due to satisfy trail development fees. This fee must be paid prior to the release of the final plat for recording 12. Tree, Shrub and Sod Planting Plan. The addition of trees,' shrubs and sod to the Plat shall be in accordance with the approved Landscape Plan prepared by Rehbein Engineering dated The trees to be protected during construction must be identified on the grading blah, and the plan must require the installation of 'tree save fences' prior to land clearing or grading. In addition, the requirement for this Plan shall be fulfilled by the DEVELOPER. as fbllows: a) Minimizing the impact of construction on trees in accordance with Minnesota Extension Service publication "Protecting Trees From Construction Damage" (Publication #NR-FO-6135-S). b) For trees intended to be planted between the sidewalk and the street, the specific locations must be staked in advance of planting and approved by the CITY. In the event the weather is not conducive to tree or planting sod in the boulevard at the time of Certificate of Occupancy, the Building Permit holder shall place a cash deposit in the amount of $300.00 for trees and $300.00 for sod in an escrow account with the CITY and upon verification of the planting being accomplished, said cash deposit shall be refunded to the Building Permit holder.
