dispose of brush less than six (6) inches in diameter and stumps with less than four <br />feet of main trunks attached. The location of the proposed open burn site will be <br />specified by the CITY. Wood disposal by burning requires whole tree volume <br />reduction, proposed site inspection prior to clearing and an open burning permit. <br />Residual ash and unburned stumpage may be buried on the site at the approval of the <br />CITY. Chipped material may be applied and utilized on site to mitigate root damage <br />from grade changes or used in the right-of-way for erosion control and top soil <br />restoration. <br /> <br />SECTION V <br />GENERAL <br /> <br />14. Payment of Sewer and Water Trunk Charges. The plat will be subject to trunk'sewer and <br /> water fees for each newly created lot. The 2005 fate is $1,100 for trunk sewer fees and $1,862 <br /> lbr trunk water fbes. This equates to a total of $20,734.00 due to satisfY trunk sewer and <br /> water ['ees fbr the seven lots that are being created. In addition, since the sanitary sewer and <br /> watcrmain are currently in place to service the proposed newly created lots lateral benefit <br /> charges will be applied to each lot. The 2005 rate for each newly created lot is $3,305 sewer <br /> lateral benefit and $7,539 for water lateral benefit. The developer will be allowed a credit <br /> against the lateral benefit charges for the costs associated with installing any necessary sewer <br /> and water laterals along with the reasonable cost of street repair. <br /> <br />15. Stor~nwater Management Fee. The 2005 Stormwater Management Fee rate is $384 per <br /> unit, which equates to a payment in the amount of $2,688 due to the City prior to the release <br /> ol~ thc final plat for recording. <br /> <br />16. Hard Surfaced Driveways. Hard surfaced driveways (bituminous or concrete) are a <br /> requirement for each lot in the Plat. Said improvement ~shall be installed by the building <br /> permit applicant orthe homeowner at the time the Certificate of Occupancy is issued or as <br /> soon thereafter as possible, weather permitting. In the event this improvement is not timely <br /> installed on a lot, the DEVELOPER and/or the DEVELOPER'S assign(s), agrees that the <br /> CITY may install said improvement on the lot and specially assess the cost therefore against <br /> the lot. The DEVELOPER hereby waives all right to a public hearing and other statutory <br /> rights or City Charter rights granted a property owner relating to special assessments, <br /> including the right to appeal the special assessment for installation of the hard surfaced <br /> driveway. In addition, the DEVELOPER grants the CITY a license to enter on each lot of <br /> the Plat in order to install the improvement described in this paragraph if the same has not <br /> been previously constructed. <br /> <br />17. Street Cleaning. After the street surfacing is installed, the DEVELOPER shall clear any <br /> soil, earth, or debris from the streets within the Plat resulting from any construction within <br /> the Plat by the DEVELOPER or its successors and assigns.
