Commissioner introduced the following resolution and moved for its <br /> adoption: <br /> RESOLUTION #21-253 <br /> A RESOLUTION GRANTING THE ISSUANCE OF A VARIANCE TO FENCE <br /> HEIGHT AT THE PROPERTY AT 15337 NOWTHEN BLVD NW <br /> RECITALS <br /> 1. Kristina Myhers, hereinafter referred to as the"Applicant", has properly applied for <br /> a Variance to exceed the height restriction in the front yard for a fence (the"Fence") <br /> on the property located at 15337 Nowthen Blvd NW and legally described in Exhibit <br /> A. <br /> 2. That the Subject Property is zoned R-1 Residential (MUSA) District; the <br /> surrounding parcels are also zoned R-1 Residential (MUSA). <br /> 3. That the Subject Property is approximately 4.17 acres in size. <br /> 4. That the proposed Fence would be six (6) feet tall consisting of treated framing <br /> materials with 6"x 6"maintenance free posts and 1' x 4' cement boards. <br /> 5. A Variance is required to exceed the height restriction for fences placed in the front <br /> yard of residential properties. <br /> 6. That City Staff noted the proposed fence height in the front yard for permit <br /> RA048649 and contacted the Applicant about a Variance. <br /> 7. That the Planning Commission met and held a duly noticed public hearing on <br /> September 23, 2021. <br /> FINDINGS OF FACT <br /> 1. That the proposed use will not adversely impact traffic in the area. <br /> 2. That the proposed use will not substantially or adversely impair the use, enjoyment <br /> or market value of surrounding properties. <br /> 3. That the proposed use will be constructed so as to be harmonious and appropriate in <br /> appearance with the existing or intended character of the general vicinity and such <br /> use will not change the essential character of the area. <br /> 4. That the proposed use will not create additional requirements at public cost for public <br /> facilities and services. <br />
